Perhaps, but he is missing a very important "S" in the domain name.

If it was me and my intent was to receive payment, before getting a lawyer involved, I would briefly explain my existing idea for the domain and send documentation with already accrued development charges as well as a 10-15% transfer fee. Of course, I would also let them know that is the only way to settle the matter w/o getting lawyers involved.

IIRC that was an amicable trade, I thought he recieved a bunch of MS products for it.

edit: If they wanted the name they should have registered it first. This isn't 1998.

Doesn't matter.

This isn't (yet anyways) a case of trademark infringement. This is a case of disputed cybersquatting-- and if it goes full term will be decided by the ICANN review board.

He has the name of their brand (Dockers) plus a generic word (store) in his domain name. Unless he can show some other reason for use of the word "Docker" in his domain name, they can and will take it away from him.

No lawsuit, no laywers.

consult a lawyer if they want it that bad they will buy it from you for m ore than 100 bucks..

saying has has dockers and store in his doamin i stretching it. considering there is only one S.

but i agree this is a cybersqquatting case.

I would have agreed to an "amicable trade" as well. IIRC he was initially going to fight it. But he was a 17 year old kid. It would have been fool hardy to send his parents into possible bankruptcy trying to defend it in court. Their initial offer was something like $50. Its only because he stirred up some grassroots support before he caved that microsoft gave him a better deal, imo.

I don't know what you can do. I remember that Mike Rowe kid got his domain taken away by Microsoft because he bought the domain of his name + soft.com in it.

Yeah, I sure hope the Dock Worker business is profittable. :roll: I'm sure dock workers have lots of expendable income and like to spend it on the Internet. Though I imagine they'd look for DockworkerStore. :roll:

Plus, if you're planning a legitimate business, then why would you even consider selling out for a mere hundred or even a few thousand?
