Re: legal elements of rape, I'm a little rusty on my crim law but here's what I remember. I believe at common law, resistance was one of the elements the prosecution had to prove. Force and lack of consent are still required elements in modern jurisdictions but if the victim is incapacitated then the force element doesn't apply. There may still be traces of common law hanging around so I couldn't say for sure.

Don't be a fvckhead. I 100% agree with what he is saying, because there are laws on the books that say exactly what he is saying. It varies by state, and he wasn't saying he agreed, but rather what the statute said. READ the post next time instead of popping off about what rape is/isn't. He's talking legal definition specifically.

Maybe in a rare case, but basically no. Few women are strong enough to overpower a man to the extent that they can have their way with him in this manner, and unlike a man raping a woman, for a woman to rape a man (unless it's in the back), she'll need to get him erect anyway.
 
I was completely taken advantage of one time in college and it was so not cool. Dude this girl raped me by definition in the dorms b/c I told her to stop and she didn't and I was to incapacitated to physically stop her. She was one of the worst lays I've ever had (looks wise at least I don't really recall the intercourse) and she scarred me for life. She knew I wanted nothing to do with her too b/c she was constantly making advances at me and I was constantly denying her!

I just wanted to give my story to you guys.

Where does he say that it did? It sounds to me like he was arguing the literal definition of the word rather than the legal -- outside of a courtroom and outside of a legal textbook, rape can happen without resistance, but it can't happen with consent on both parties' part.

Not trying to stir anything up, just trying to clarify the debate.

Yes, guys can be raped. Most of the time it will include some sort of physically debilitating drug, such as being very drunk, put to sleep, unconcious, etc. Sometimes the man will just be asleep when it happens. I doubt there are many cases where 3 girls mug a guy in an ally way and gang rape him.
