It would work for a black man in front of a jury if the circumstances were the exact same: a reporter assumed to be over 18 really was over 18.My opinion is, ask yourself if 'she said she was a reporter, I assumed she was over 17' would work for a black man in front of a judge/jury. That might provide some guidance in this case.

When Maria seemingly invites Rudy to the bedroom with "Shall we have a drink in the bedroom?," they show her ahead of Rudy and then cut to a shot of Rudy wandering into the bedroom and beckoning her to "come here." I don't know why they wanted it to look like Rudy was leading her when she was clearly the one inviting him to the bedroom for drinks according to their own ADR, but they actually went through the effort of digitally erasing her from that scene. Even if her invitation wasn't clearly added in post, you can see her appear in front of Rudy for a moment as he passes a light stand. Special effects: FAIL. Double-FAIL since the effect was pointless anyway when we already saw her leave the previous frame ahead of Rudy. Splicing audio to make it sound like he said "come here" doesn't change the context at all because she already invited him! The whole scene is a mess.
Guess they thought the low-res grid filter would hide their SFX goof.
I didn't get the impression SBC was serious business.
As @purbeast0 said, it does look more like he tucking his shirt in. I think if there's anything to be concerned about it's that he went into the bedroom and how long it took him to tuck in his shirt....while laying on the bed....lol. I mean, what do people think he went in there for.

The "serious" part is what prompted this thread. The media ran with the story and SBC played into it with their fake defense of Rudy video, implying Rudy really did do something to be ashamed of.
Anyway, they looped the tuck from a different angle to double the perceived time it took to tuck it in, so even that wasn't actually a concern. Since the dialog was manipulated the context of him going in there was likely manipulated too. It's very likely that one of the fake documentary crew people told him to go in there and not her. It's possible he never once thought they were alone. Most (all?) of his interactions with SBC pretending to be a sound guy were faked. It seems to me that they tried desperately to salvage a failed prank with ADR, reshoots, looping alternate angles, Rudy stand-ins, etc and this is what they came up with.
Yes, they had an actor standing in for Rudy. Those weren't his hands flipping through when they showed the book. The ring is different as well as the number of buttons on his sleeve.
