Did I give legal advice? I simply pointed to the statute which sets out penalties for possession of controlled substances.

If anybody should be concerned about legal advice, it should be you. Last I checked, you're the one with the incompetent attorney.

She's already been convicted tho right? Was that when she was a minor so it was erased when she turned 18? If this is her second offense it could be a lot worse. 70% of all inmates in California are there for non-violent drug offesenses, don't be so sure nothing will happen. As for your situation, jeez you really need to be a little more tolerant. If all you're having to do is put up with the smell then I think you should be able to do it for free room and board. Maybe your dad doesn't condone what she's doing, but he tolerates it. It's better to be doing it in his house where he can watch her, then living on the streets getting mixed up with much worse drugs than weed. Maybe you could be a little more tolerant too. You're 22 and in school so obviously you won't be living at home forever. She's chosen a lifestyle that you don't agree with, why don't you try buying some potpourri and easing up a little. I guarantee calling the cops is not the answer and you won't get busted if she does, if you just say you didn't know she had it when she was caught. I know a lot of parents who kicked their kids out of the house as soon as they turned 18, it sounds like your dad cares about you and your sister for allowing you to live with him for so long and allowing both of you to come back after leaving, couldn't you show him the respect that he deserves and obey his wishes while in his house? Anyone who is informed on the subject knows that there is not one good reason for alcohol to be legal and weed illegal. Don't put all your trust in the laws. Remember at one time slavery was legal, would you have turned your sister in for freeing slaves? Not at all the same situation, but I think you see my point.

I agree you shouldn't have to breath it if you so strongly object to it, but to call the cops? And freak out about cocaine?
You are just another person led to beleive that marijuana is a stepping stone the "hard stuff".
Maybe you should go hang out for a minute in her room, and take a breather.



 
I'm sorry, I would just like to make another plea for you not to call the police. Jail is a really messed up place and if your sister was sent there, she would probably never be the same again and never forgive you. Believe it or not I'm in a very similar situation, but nothing dealing with drugs. I'm going to college too, I'm 21 and I have a younger brother whose 20 and due to an internship I have right now, I'm living at home again. We don't get along at all and infact fight quite frequently. Not only do we fight but he steals my stuff while I'm gone at work and has no respect for anything I own. Sometimes I think I would love for my parents to kick him out of the house just because he's such a jerk to everyone, but they won't. I understand why, they love him and he obviously isn't mature enough for the real world yet, so they'd rather put up with the crap, then worry about him on the streets. Like I said you're 22 and in college, you're going places. Maybe your sister will straighten out as well, she just needs some time to be crazy, and your parents are giving her that by letting her stay at home rather than forcing her to sink or swim by kicking her out. Don't ruin her life and your relationship with your family because your 20 year old sister is smoking weed(she's not even close to alone in this). Other than it being illegal, there's nothing wrong with it. If you need to talk to someone or tell someone, talk to me, I'll give you my number and we can chat. Anything but calling the cops.
