Until the big crackdown on drunk driving a decade or so ago, most states' DWI level 0.15, and even then it was frequently nonconclusive evidence of intoxication. As Skoob hinted above, lots of people appear functional at that level (ie, not falling down drunk). That's pretty damn high for someone on the job, though-any job much less a road cop.
