I'm in Georgia, so it is legal to carry a firearm in your car. If someone with road rage jumped out of their car and started yelling at you through your window could you threaten them with the gun? Or just flash the gun and not point it?

The question is, if the guy in question sees your gun and feels threatened and shoots you, does he go to jail?

it's better just to calmly say. "i have a concealed weapon. If you continue to threaten me i will be forced to 'defend' myself."
make sure to use scarequotes.

So what's the point of having it in your car? Do you have to feel your life is threatened before you can pull out the gun?

You can't draw a weapon without intent to use it. That's what they teach in concealed carry classes. If you draw your gun, someone had better be shot. Otherwise, you're in trouble.

Correct, Brandishing a firearm is a no-no. Only present a weapon when you are going to use it (meaning you are defending your life or someone else's). "I feared for my life so I shot him/her."

Well, that's a two-edged sword. If you DO shoot someone out of the fear of your own life, you have to prove that your life was in danger and that drawing your weapon and firing was the *only* means of your escape. Even then, the guy you shoot can press charges against you for assault and battery. If you kill him, his family can sue you, but I don't remember what for.

Our legal system is all effed up here in Oregon.

I want to live in Texas where I can legally shoot those who I deem to be trespassing anywhere on property that I own without legal reprocussions other than proving that they were on your property (well duh, the dead body is within my property line) and proving that they were trespassing (duh, I told him to leave and he refused). :D

There is a rule of thumb EVERYONE should follow when using a firearm. NEVER EVER BRANDISH A FIREARM IF YOU DO NOT INTEND TO USE IT. DON'T EVEN THINK ABOUT IT. It is stupid, a legal mess, and can get you shot very very quickly. Just don't do it unless you are ready to maim or kill. It's not a toy, it's not a magic wand, it's a deadly weapon and there is no telling if the other guy has one, feels more threatened than you, shoots and kills you first (and I dont give a damn how many hours of video game duck hunt training you've had or if ur a marine), then gets off scott free cuz u did something stupid like brandish a weapon at him.

No, (at least in the state of Florida) that is a felony. You would need to wait for them to pull a weapon.

Uhh, yeah, does that not make sense to you? The last thing we need is a bunch of wild eyed cowboys brandishing guns in traffic...

too bad you don't live here in FL. Starting in October we can shoot anyone if we ever feel threatened...no "can i just point it at anyone" kinda sh!t...just say "you done fvcked up" and shoot him. later when the cops come, say he threatened you (as evident by him getting out of his car and walking up to your window). case solved and no charges can be filed. gg wild west

I have a license to carry and I understand the meaning of concealed. I always wondered about this, but I know the answer is already NO. But if some dude jumps out of his car with a crowbar or something, what are you supposed to do? Yea you drive off to avoid confrontation but let's say you're stuck in traffic. Worse you have your kids or wife in the car with you.

I only ask because I was stuck behind a couple of cars on a one way street. The guy in front of me honk and when the first car didnt move he got out to see what was going on. The first car had 4 young males in it and three jumped out to beat the dude in the second car. In that case, could the guy pull out his gun? The kids just sucker punch the man and left.

I knew better, it wasnt my fight so why would I get involve? They got two hits in and left. Mind you if that was me maybe I would've pulled my gun out. Besides, cops where I live wouldnt give two cents with that stuff. The kids probably would've gotten off.

Why brandish? If he lays hands on your car, especially your door handle, just let him have it.
