Protesting funerals, homosexuals, Jews, and other groups, as well as supporting AIDS, HIV, and IED's as Godly judgment are protected by the Constitution. Just as certain "artists" get away with wiping ass on the American flag, tearing apart Bibles, simulating oral sex and the consumption of urine on stage, and other disgusting habits.
The founding fathers knew that they could not enforce morality on American citizens because doing so would violate the separation of church and state that has been so critical to our freedoms.

They relied on the people of this nation to hold their ethics near to them so that the nation could prosper under strong leaders and citizens. Once these ethics are let go, we are left with extremists of either persuasion who will go to any limits to impose themselves and their message.
