Can my GF's work do this?

My GF just recently got a job about 2 months ago. At the interview she was told that upon hiring she will be getting pay around 30k a year salary and that she will be hire as a temp in the begging a probation period. Then they said they don't know how long the probation period will be it depends how well she work, it could be shorter or could be longer.

Last night my GF came home from work at 1:15AM !!!!! :Q She went to work at 8 AM !!!! Then went to work again this morning at 7AM !! According to the company because she is on salary there is no OT pay. WTF? :| and because she is a temp she doesn't get any benefits either :|

and check this out.. After the 2nd day of her work she found out from her co-workers that the company is closing in July !! so clearly you can see what this company is doing they are avoiding paying the benefits for the employees by hiring them temporary but working them like a slave and won't pay them Over time.. Can they really do this??? :| :| :| :| :| :|

If you're on salary, you don't get paid overtime...looks like she should find somewhere else to work.

If I were here go into work tomorrow and talk to the manager and see where they are going with her job. There is no reason for her to be jerked around like that. Most managers will be straight with you if you act mature in the questioning.

i've known people who get home at 3-4AM and go back to work at 8AM near deadlines. no ot. sucks being on salary sometimes.

Salary = no overtime

Her situation does suck, and that company sucks even worse from the sounds of it. I agree with CadetLee, find something else.

Isn't it a requirement that you get 11 hours of rest in between scheduled shifts?

Sounds all legal (you don't get OT for salaries, and you don't usually get benefits for temp position)... moral, i don't think so.

also, if the company closes in july (take that with a grain of salt by the way disgruntled employees are known to spout nonsense) she should be looking for a new job anyway.

Being on Salary isn't always bad. Depends on who you work for and the type of job you do.

I work on Salary, but have practically unlimited sick time.

I work Overtime, but use it up in comp time, means I get to save my vacation days. :)

unfortunately her manager is unlike other managers. Her manager are super anal. Yells at his employees and critize his employees every chance he gets. From what I have heard he had made 2 sectaries cried and ran off all within a month!! My girlfriend's co-workers were having bets on how long my gf will last and they were suprised that she lasted 2 months.

Funny thing about the salary is that.. from what I understand because she is on temp her salary is converted to hourly wage.. i am not quite sure how it works. I will ask her when she comes back from work... yes she is still at work right now :( that's 13 hrs of work today, 17 hrs of work yesterday. :(

YMMV, but here in the Commonwealth of Tax, er, Massachusetts, if you ARE NOT managment, your employer must pay you for hours worked over 40. They are quite particular on what constitues managment also. Perhaps a dime dropped to the local labor board would cause things to change....

depending on the state I wouldn't be surprised if this were illegal. I don't think you can pay an hourly wage and NOT pay overtime.

Yup.. that's what I have told her today at her break.... She was at the edge of crying :| I told her it's not worth it. The reason that she wanted to stay as long as she can was because she doesn't have many experiences and this job she got is a Project Manager position she was hoping to stay as long as she can so she can put it on her resume. She just recently graudated from college with no other job experiences and you know how hard it is to find a job right now :(

Tell her to get off her butt and do something about it. Go look for another job.

The day my ex-boss at a previous job told me to my face he didn't care (about what I won't say) I was out looking for a new job. Where I used to work was a good job. But after 4 months I found an even better job, working with people I really enjoy working with.

Tough economy or not, nothing is gained by sitting around and crying. Tell her to start looking!

Hey, I said the same thing to my wife. She got off her butt and finally went and looked for a new job(that didn't treat her like dirt). She found it 3 months ago, and has been very happy ever since.

Look, yes. Find? Not necessarily. I'm guessing by this comment that you're not currently looking for an IT job. The industry is not good right now, and it's not easy to find something. Plus he mentioned that she didn't have a lot of experience, and that makes it even harder right now. It's not like in past years where you had 5 IT jobs for every new graduate. Now, make it like 1 job, and throw into that people who have been working in the industry 10+ years competing for the same jobs.

Sure, but saying that someone should "quit their crying" and go look for another job isn't fair either. I don't like my job, and I am looking, but as of yet haven't found anything. Does that make my dislike for my job any less valid?
