CA passes unloaded open carry ban

AB 144 was signed today by Jerry Brown which makes it completely illegal to carry a handgun in public for most citizens of California (CCW permits are difficult/impossible to obtain and loaded open carry is illegal).

I, for one, am glad our valiant legislature has protected us from the dangers of unloaded guns! D:

Well, I guess the bad guys won't be able to exploit that law to their advantage. OTOH, actors and such from Hollywood won't be able to keep fully in character when they go off the lot for a quick lunch or din-din.😛

Sorry, this isn't the 1800s anymore. There is absolutely no reason to openy carry your weapon in public. My first reaction would be to call 911 if I saw that shit. It just isn't a normal thing to do. I'm cool with concealed carry though.

How can you tell if it's unloaded or not if everyone is packing exposed heat?

If you do something unlawful with it (like point it at someone or do something stupid), the cops can check and if it's loaded there are consequences for your actions. Thus, people who don't do anything stupid can carry and those who do stupid things can't. That's much smarter than just banning it for all such that the criminal will do it anyway and the law abiding citizen has their rights abridged.

now, CA is still dumb, but wasn't this ban supposed to make support for CCW easier somehow?

Most places define "unloaded" as not having the magazine in the weapon. Even if the magazine is without a single round, the weapon can be considered "loaded" with the magazine in place. Then it is very easy to tell a "loaded" from "unloaded" weapon.

I support California in this measure. The more anti-gun they are, the more pro-criminal they become. Its a self defeating law. Soon, as was the case in Chicago, criminals will run rampant knowing how easy it is to take advantage of an unarmed populous. WTG California, Darwin would be proud.

Also, anyone who freaks out at the sight of a gun, loaded or unloaded, really needs to get their head examined. Do you do the same thing when you walk into a kitchen and see all the knives laying around? Didn't think so.

I agree with your first paragraph and that it's stupid for CA to not have unrestricted concealed carry on public property. However, the 2nd amendment was a limitation on the Federal government, not the states.

Yes, the 2nd amendment was a limitation on federal laws, but as the SCOTUS has already ruled (see Heller), it also prevents local and state jurisdictions from passing laws that infringe on one's constitutional rights.

There are specific circumstances where the potential risks outweigh the benefits, and there is distinct clear danger. In those instances, it makes sense to have restrictions. Otherwise, not so much.

Sounds prudent to have law enforcement keep tabs on a guy openly carrying a gun. For all I know, he could be a crazy fvck on his way to a shooting spree.

What reasons did an individual have in 1800s to carry a gun? And how do they no longer apply today?

simply walk towards the barrel and inspect whether there is a bullet in the chamber. preferably about two or three inches away from the barrel.
 
This law will naturally bring with it a shit storm of lawsuits (rightfully so!) and the hope is that CA will be forced to become a "Shall Issue" rather then a "May Issue" state in terms of CCW licenses. Up to today only the rich, politically connected and famous are generally regularly issued CCW licenses renewals each year. Of course to a criminal such as a gang banger this doesn't mean shit to them because following the letter of the law is just hassle they can forgo at anytime they feel emotionally okay to do so in their line of "work". However if you are homeowner and a natural or man-made disaster (earthquake, social unrest, etc) strikes and law enforcement is nowhere to be found in your metro area (because they are dealing with riots and looters) you will care about this a little more, especially if your family or property is in intimidate danger.

Open carry is retarted and only useful in situations where one needs/wants attention at any costs

Im referring specifically to open carry in an urban/populated environment

Id rather not be target#1 during the quickmart robbery thank you
