What about a dead body in a rental car in her name? You don't think they were looking to get these people after they skated on a homicide?

It sounds enough to raise an eyebrow and an indication to investigate further.

It doesn't sound like enough to justify a warrant.


In order to justify a warrant - I basically think you need to have 99.9% proof - with the remaining 0.1% being the warrant saying "Yeap, it's here."

If you don't know PRECISELY what you're looking for (and no - broad generalities like "I'm looking for drugs" isn't what I mean) then I don't believe a search warrant is justified.

No. Just took part in a drug trafficking ring and was around people who offed a mofo in her rental car. Also said pieces of shit took a shot at police as they were serving a justified warrant. You do realize the guy that dealt some drugs was her ex boyfriend, as in the past. You do realize that they even offered that ex boyfriend a plea deal that was beneficial to him if he implicated Breonna Taylor in criminal activity, and he refused. You do realize that the actual current boyfriend in her apartment at the time of the break in by the cops had no criminal record and legally had a conceal carry permit for that weapon he fired. And Louisiana has castle doctrine, so he was well within his rights to fire a warning shot when the door was broken down. It's amazing you can call him and her criminal pieces of shit.

It was a justified warrant. They got info from surveillance and ran it by a judge. The judge signed off on it.

If you'd like to change the process you are more than welcome to try but at this point that is how a warrant is obtained.

Didn't really see a dedicated thread on this - yet this was a major recent decision that will inevitably spark this week's protests.

Attorney general ended up only charging one of the officers - and it wasn't for murder but more along the lines of recklessly shooting.





Personally I think there's some problems on all fronts. Irrational frothing at the mouth lefties won't settle for anything other than 1st Degree murder charges for each officer.

Righties will probably say the officers are entirely innocent.

Reality is somewhere inbetween. If officers are being shot at - you can expect fire to be returned. Goodluck getting a murder charge. Are you expecting them to cower in fear and run away when shots were fired?




But what pisses me the fuck off about this whole thing is the part that NO ONE cares to discuss.... Who is ultimately liable for this? The answer is REALLY fucking simple. The person most liable for this is the judge that approved a warrant. Period. End of story. They are the cause of this. They are supposed to be the checks and balance. They weren't and they never are.

2nd person that is liable should be the officers, investigators, etc... whomever presented the (obvious false) evidence to the judge.

Those are the parties responsible for these events the most. But for some blissful reason we just ignore that and just directly point the finger at the officers that were tasked with performing the warrant. They conduct the warrant - and they get shot at. They respond with shots.



Doing things like raiding a home with guns drawn should require SUBSTANTIAL evidence to approve. I'm talking documented videos and photos of people hauling in bricks of cocaine/heroin or something to that scale. They make it sound like there was a meth lab going on - but the reality was obviously otherwise.

Judge would not be responsible if fed false information on the warrant application. IIRC that is one thing which has been alleged here.

So far as "liability," they already paid $12 million to Taylor's family. So the matter is now moot.

You "basically think?" I honestly have no idea where you got this. A warrant requires probable cause. The degree of certainty of a crime for PC is under 50%. It goes like this:

Reasonable suspicion - for stop and frisk, which is a pat down search.

Probable cause - for all other searches and arrests, and for a grand jury to bind a case over for trial.

Preponderance of the evidence - for a plaintiff to prove a civil claim.

Clear and convincing evidence - for certain very specific issues in a civil context. Term is also used in the NFL for degree of proof needed to overturn an official's call on the field.

Beyond reasonable doubt - to convict someone of a crime.

While the legal system doesn't concern itself with assigning numeric degrees of certainty, one that is clear the middle one. Preponderance means 51/49 or better, more or less. Probable cause is less than that.

No, police are 100% responsible for this death.

Shifting the blame to the judge is silly. Judges didn't come up with no knock warrants.
plus they have to rely on the sources of the info the warrant is based on, if the info in the request for the warrant isn't accurate it isn't the judges fault, they're relying the information supplied by others. this falls directly on the police.

It was a situation that they created. The settlement reveals it was not a defensible position, and they need to knock this shit off. It may take more police hours to take down suspects in controlled situations, but it seems to me anything that keeps them from tossing lead around like that would be favorable.

The city isn't paying 12 million dollars because they did nothing wrong. They aren't paying the money for fun.
 
you misunderstand me, of course they did something wrong. They are paying because there is no defending the situation that they created.
