Boxspring flew out of a pickup on the freeway

Dumbshit truck driver didn't properly secure the boxspring, so it went flying out of the truckbed in the middle lane of the freeway. There was no way to swerve out of the way without hitting other cars in the other lanes. She ran right over it and shattered the boxspring. A metal rod from the boxspring went right through the bumper and punctured something under the hood. some kind of liquid leaked out after i pulled the rod outta the bumper.

Poor girl. It was only 12 days ago since she drove it off the lot.

Question: Should the driver at fault cover the cost of a rental while her car is in the shop?
 
Usually, your insurance covers the cost of a rental car...IF you've paid for the coverage. Yes, you can try to get them to pay for it, but depending on your state's laws, they MAY be able to refuse.
I hate...strongly dislike...asshats who do stupid shit like that. It's not like it takes very much work to properly tie down a simple load like a mattress/box spring set...
 
Yes, the driver pulled over. We got all the info, got an accident report and filed a claim with the driver's insurance. The driver was driving a company vehicle that was fully insured. Neither I, nor my girlfriend have ever been in an accident so we're still trying to figure out the best way to proceed. Any tips would be greatly appreciated.

It was not my intent to imply insurance fraud but do make sure your GF has not sustained any injuries. Some may take up to a week to show up.
 
Was the liquid thick like oil or was it more water like? You should be able to report it to your insurance company and give them all of the truck driver's insurance information and they should take care of getting your vehicle repaired.
 
I saw a wooden bench fall off of a commercial truck onto the highway about 300 meters up the road once. Apparantly the old people in teh car next to me didn't see it. I slowed to let them make a lane change but they just plowed right into it sending wood everywhere and swerved all over the place.

Also irrelevant from a practical standpoint, in that even if she were following at a normally acceptable distance (which she probably was), the OP stated that she couldn't swerve out of the way because of cars in the other lanes. Even following at a normal distance, she still would not have had a choice but to hit the box spring.

Yes, But you will have to fight for it.

It was windshield washer fluid.
No other under hood fluids are blue.

Just submit the claim to the insurance company thats about all you can do!!
There is noway to speed up the process!
Oh by the way-- be honest about things -- if there I no injury or mentall distress don`t try to jack the insurance company out of money!

What color is air conditioning oil in cars these days? The condenser is close to that area too. Make sure it still cools properly.
