A lot of the reason people get divorced is over mindsets indicated in this thread. Pessimism that it won't work combined with the importance of money over relationships.

A guy who shouldn't have gotten married to begin with will say fvck her look at all this money I lost. A guy who is more marriage material will say yeah she cost a lot but I still have a lot and more importantly, my marriage just fell apart, that sucks more than some money lost.

I'm not arguing out of fact, just out of how it probably should be.

Once it's in their bank account they can legally split it up however they want without incurring another tax. It should NOT be taxed because it is not income, it is already earned assets. It would be insane to tax things during a divorce. The government has already taken their cut, why do they suddenly have a right to take more? The finances of people getting divorced are none of the IRS's business.
