Biden moves to mandate vaccines for large part of workforce

This should help out a lot of businesses struggling with this on their own and worrying about losing workforce to companies that don't require vaccination.

This will level the playing field tremendously

i imagine an injunction will arrive in short order. we'll be a few variants down the line by the time litigation finishes.


edit: VERY curious how this will play out at my employer, who qualifies for the mandate (> 100 ppl). Will the unvaccinated be fired? leave in protest? Verrry curious indeed.

tangentially, I suspect this will solidify Biden 2024 for a lot of people, either for or against. This is no small decision that conservatives are bound to rail on until the election is over.
 
I don't think the USSC steps in on this one, the precedent on this sort of federal contracting requirement is overwhelming.

I am curious to know the extent. Will this apply to Medicare contracted health providers? The integrated health system I work for has been hesitant to outright mandate vaccines. It's fairly clear that the EO will apply to the health insurer component of the IHS since we contact for Medicare Advantage. How will that carry through to the hospital and providers?

This is the most nakedly partisan supreme court we have had since the time of the robber barons. I wouldn't put any faith in precedent in them.
 
While the law is entirely on Biden’s side and it isn’t even close I still think the odds of SCOTUS blocking it are very high because as others have said it acts more like a Republican controlled super legislature now and I’m confident they will have no problem inventing some reason.

In short OSHA clearly gives him this power but SCOTUS will pretend otherwise.

I imagine it's going to break for Biden. A large proportion of the antivaxxers are Blumpkins that wouldn't vote for Biden if their life depended on it. Meanwhile, I think most everyone else is fed up with them. I see virtually no downside to this.

My money is on them not overturning it, but I'm only 60/40 on that. I can see no legal reason whatsoever and sometimes this court does go against the republicans.

Also, it will critically matter if the lower court grants an injunction on enforcement while the matter is pending. Because of the nature of this policy, it really only needs to be in effect for a matter of months to achieve its purpose.

My bet is they overturn it and do so in a way that calls into question a large portion of OSHA regulations.

I added a comment after the initial posting. I think the issue may be moot by the time it reaches SCOTUS unless an injunction is granted.
 
Did Biden ever read the 10the amendment? This will never survive court challenge. It's him talking out of his ass and trying to show that he is doing something when i reality what he is doing is not enforceable except on federal employees/contractors.

So to be clear you’re saying OSHA is unconstitutional? Because if it isn’t he 100% has the authority to do this.

Told you the mandates were coming and you didn’t believe me.
 
No Each state got their own OSHA. Biden tried it with eviction and failed, this is no different.

Has their own OSHA. And no, they don't, not really. OSHA allows states to have their own equivalent, but only for state employees. Only five states actually have one though. And of course, private sector employees everywhere are covered by OSHA.

It's a local issue , state can order citizens to get vaccinated per 1905 court ruling from SCOTUS. What Biden is trying to do is have federal government order business to do it bypassing state control . That is why why CDC eviction ban failed and that is why this will fail as well. Congress will need to specifically give federal government this power and that obviously will never current congress/senate
