Disagree. We can recognize that the baby is in fact a baby without imposing any requirement that its rights supercede the mother's rights. Otherwise punching a pregnant woman in the stomach and causing death to her baby would be no more than simple battery.


So.... if a woman is murdered while walking into a clinic to have an abortion, is it a double murder or not?

IMO, even though her intent was to kill it anyway, I can see the argument for still making it double murder for the following reasons:

It is her choice to make, not the killer's.
There was still a chance that she may have changed her mind before actually going through with it.

You aren't strictly pronounced dead when your heart stops, else anyone who ever had a transplant would be a walking dead person.

You're pronounced dead when your brain has died, which is virtually a certainty when your heart stops in all but some exceptional cases (like transplants, for example).

Ignorance abounds.
Technically you are correct about definitions. But from practical experience, how many dying hospital patients are hooked up measuring brain activity? They are much more likely to have their hearts and breathing monitored.

Yes, because . . .

this. Whether or not she is adamant about aborting it, it's still her choice. It's like stealing something; even it was going to be thrown out, that doesn't make it up for grabs before hand.
