The other thread was started before he was charged with anything.
Just looking for opinions on what his DEFENSE tactics could possibly be.
I think he will be found guilty of manslaughter ...... I don't think he meant to do it.

If Oakland ended up burning to the ground, I dont think anyone would really care. Let them riot, and dont even waste our national guard resources on stopping it.

All this discussion is academic anyways. That motherfucker is going to prison on a stupid mistake. Next time, he'll realize what powers a weapon has and carry a similar burden of responsibility when using it. Perhaps he won't be so stupid.

I'd argue the same will hold true even if he doesn't testify, based on the video. Ergo, the City would be encumbered with the expense of a trial and the prospect that he will probably only be convicted of manslaughter anyway. If they're foolish enough not to instruct the jury on the lesser included offense of manslaughter, he will walk 9 times out of 10, and imagine the riots that will result then.

I suppose there's some chance that there is other evidence that this was an intentional shooting that might tend to obviate what we see in the video. In that case, I guess it's possible, albeit very unlikely (I'd set the odds at 5% or less) that he will simply plead to murder or voluntary manslaughter. I would find that VERY surprising, but criminal law is like that sometimes.

I still say that at the end of the day, whether he pleads guilty or not, he ends of convicted of involuntary manslaughter and sentenced accordingly.

Luckily CA doesnt have any tax money left to spend, so I'm thinking a museum of some sort. Fly-over tours out of San Jose/SF maybe? Think of the revenue for the state if they ran it.

Both.

I definitely think it's VERY unfortunate that a DA is having to make prosecution decisions based on the prospect of a riot, but as a practical matter their decisions are often heavily influenced by politics anyway, and I regard that as a similarly irrelevant contaminant to their ability to do their job.

Maybe, maybe not. The videos definitely help ensure that justice is done, in any case. In my experience most cops will lie to protect other cops, but in this case there were literally hundreds of witnesses, and I'm sure at least SOME of them weren't crappy witnesses by virtue of felony convictions and other credibility problems. I for one think it's a good thing to the extent that bad actors of all kinds (including but not limited to police) have to act with the knowledge that someone might have a cell phone camera nearby.

If prosecutors would do their jobs 100% all the time everytime, they wouldn't be under such pressure. When something happens to a celebrity they put all their resources into that, but, G-d forbid, if something should happen to me, you, or some other poor resident, you think they'd give a fuck? I, for one, was happy to see those Rodney King riots because it just showed how political justice can be.
