There's a difference between defending someone on the basis that there is insufficient evidence to convict and defending them on the basis that their conduct is not criminal, even if the elements are met. Mitigating circumstances are normally an issue for sentencing, not findings.

Like I said in the beginning, these discussions are academic. But the people of California will know their fate if they don't reach the right verdict.

They're fed up after one guy got killed? Cases such as these do not happen every day and you know it, no matter what the race baiters and anti-cop brigade says. Regardless of his excuses, there was pretty much no doubt he was going to be arrested after an investigation.

I doubt there will be any riots but I wanted to argue the merits of a riot. Besides, with a Democratic President in the White House (a black President, no doubt), riots won't be necessary this go-around. All the cards are in place for a rightous verdict and peaceful outcome.

You really don't have a clue, do you? The partisan affiliation and race of the POTUS are as relevant to an assistant DA in Oakland as the partisan affiliation and race of the President of Iceland.

I think they should set up razor somewhere out in the country. Then the National Guard should be called up by the tens of thousands and establish a presence in Oakland. Have the trial, and if there are riots go in and round up every perpetrator and put them in said compound. Give them a trial (of course it may take some time before everyone gets their day in front of a judge). If there are more violent protests rinse and repeat. If there are 50 thousand locked up, so be it. It's about time people learn they aren't "special".

I wonder what his qualifications for this post are? How much training did he get from BART? How many prior complaints against him for excessive use of force? Ad nauseam.

The civil lawsuit against BART will be a doozy.

Defenses?

1. PTSD (He's an ex-Marine?)
2. Temporary Insanity? Is that viable in Cali?
3. Improper training, too many working hours, bad equipment. (He meant to pull his Taser.)
4. Self-defense. The guy reached in his pocket, and his erection looked like a snub nosed 38 special. ;) (We won't ask why decedent had an erection....)
5. Too many donuts sent his blood sugar raging, and he lost consciousness and control. The chocolate chip cookie defense!
6. His anti-psychotic medication which he forgot to tell BART about needed tweaking.
7. It was Obama's fault. Elect a black man as Prez and this is what happens.

Yeah, it's a problem for people when they can't even convince me of their arguments. What's really sad is that I can just as easily take up their position and provide a much better argument.
