Fuck yeah! Judges (non bought off ones) are our only hope with these robosigning crooks.

Of course Bank of America refused to pay the judgment. Why not? They think they are above the law & they are in DC. This judge said "don't think so":p

They were barely beat out for Consumerist's Worst Company in America 2011 by BP (49.13% to 50.87%). Draw your own conclusions.

I have no idea why people bank with the big 5 banks anymore after way they fucked people in court with robosigning, tax payers with bailouts, investors with MBS, etc not to mention your local regional bank probably has better service and fees.

Worst bank that I've dealt with. Had an automatic payment scheduled and it did not go through. They charged me a late fee and when I disputed, they told me that I was late and nothing they could do about it. I then directed them to the payment schedule page and they had no explanation as to why the payment was sitting there, not cancelled nor executed. I've since dropped them (only used them for the 0% money anyway).

Interesting. The exact same happened to me before; I scheduled a payment, time passed and nothing happened. I was lucky that I caught it right away, made another payment and phoned in some major noise so I wasn't burned but I still feel paranoid enough that I check every month now.

Of course, their explanation was "web server maintenance problem, be prudent and check".
Okay... I'll contact my team of scientists and tell them to start working on finding out why their critical systems being faulty should be my fucking problem.
Honestly, I'd drop them too if I could find a less morally bankrupt corporation within driving distance.

Does this mean if congress defaults on our loans we can padlock capital hill?

I thought most of the US debt was owned by China. If the congress defaults, then thats pretty much like locking your own house.

For the couple and their attorney, walking over to the bank (with law enforcement) and shutting the place down had to be absolutely awesome. Start clearing out desks, computers, cash etc. Epic :)

Precisely the nature of this article? When you own property, you have the ability to make legal claims for it. If the government owned everything, and a bureaucrat made some mistake which caused someone to get kicked out of their home, you think they would have the same recourse?

What the couple and their attorney did is a very common legal practice known as an execution of judgment. It's done all the time to force unwilling judgment debtors to pay up, nothing particularly unusual about it except the underlying fact situation of the original judgment.

It would have been easier and more efficient to involuntarily collect this judgment through other means, such as garnishment, but that wouldn't have generated the publicity.

Money could not buy the massive free publicity this stunt gave the couple's attorney though.

BoA can suck it. They used to be a fairly decent bank, but in the last 10 years or so they have gone full blown nuts.

The last accounts I had with them was a mortgage and checking account. Decided to pay off the mortgage in full using the checking account. They tacked on an EFT charge to pay off a BoA mortgage with a BoA checking account. They also added another charge to close the paid off mortgage account (I would think that having a zero balance on your mortgage would automatically close).

About two weeks later, I got not one but two nasty letters in the mail stating that I have terminated my auto-payment of my mortgage and that I could suffer fines and surcharges if I did not manually mail in my next month's payment.

The biggest problem with BoA, IMO is that they have gotten so fragmented in their departments and sub-departments (and sub-sub-departments) that their left hand does not know what their right is doing. For example their "Escrow Insurance Outgoing Payment Department" does not work with their "Escrow Incoming Insurance Bill Processing Department".

I love my little bank. My wife logged in to our account this weekend using *my* computer instead of her computer. She's never used my computer for banking before. She was locked out of our account until she called the bank from the registered phone number, received a text message to our phone, and used the key number in that message when logging back in to our account. I thought it was a very nice touch; it inconvenienced her for all of 1 minute. A couple weeks ago, my son lost one of our debit cards. Within minutes, our debit card was cancelled; but the human we talked to (wow, humans), also noted that a couple of automatic payments that would have been taken out with the debit number during the next few days were okay to allow. ZERO problems from our end, and nearly effortless in both cases.

I don't use any of the big banks. I started using a credit union over a decade ago and I still use them. Great customer service, very little hassle.

Why did BoA prusue this when it was more than likely discused by the lawyets that the couple never had a loan and they have the deed?????

Somebody should be charged with attemped theft.
