That's not quite true. Malls are subject to the usual laws of course (no racism/sexism/etc) but they're also subject to certain speech laws in some areas. As they're the modern version of the town square, they're not always allowed to throw people out because as a town square the citizenry has the expectation (and dare I say right) that they can use the space to exchange ideas. No, racial profiling would be if they arrested a normal dressed Haitian for dress code violations, or if they didn't arrest any white dudes who were also wearing the low-hanging pants.

So no, a mall isn't completely a private business. They do have additional rules they have to adhere to that prevents them from completely limiting who can be on their property. Not that any of this would have made a difference for the family in question.

I agree. People cry racism and that 'white' people wouldn't have been arrested for something like this. Problem is they probably would be if they did follow the same examples. I am sure with the Wellington Mall being in a predominently white neighborhood, whites would outnumber the minorities on any arrest/incident sheet.
Nah, I know what I'm talking about. There have been several court cases over the years on the subject, and at least a few of the times the courts have upheld that malls function as special places where free speech is upheld on the grounds that they function as town squares. a mall is completely private, I am thinking you are trying to think behind rose colored glasses.
If a mall official or even a shop owner decides they want you out...there isn't much you can do other than a civil case which is always an option.
These people I am willing to bet have already contacted a lawyer with intent to play this up.
