They need to get their act together, as they've been riding the 9800P in the midrange since before the dawn of time. That is very debatable if you're talking about PCI-E cards.

Once these are available for close to MSRP (say within $30) then I'll agree that they are available.
When a card is only in stock @ a limited number of places and when they are charging 50% over MSRP, then the card is simply not available, especially when you look back @ the AT X800XL review where it was noted that one of the main purposes of the card was to get a good supply in the pipeline upon release in order to prevent the problems that occurred with the X800Pro and X800XT @ launch. It is quite evident ATI and their partners have failed @ that goal.
However, it won't really hurt them too much because NV doesn't have a good PCIe upgrade path for those with 9700pro's or better either. The 6600GT (and 6800 standard) are definitely a step up, but not a large enough one IMO. I think many owners of 9700pro's or higher are still waiting for either company to get a PCIe card between $200-$400 that offers a substancial improvement. I know I am. I am really looking forward to the X800XL, but I wonder how long I'll be waiting until they are as available as the 6600GT or the last gen cards.
