This whole process, or lack thereof, is a farce. I find it hilarious that the temporary injunction was issued without a hearing or any opposition by samsung. Ex party or parte, whatever the proper word is.

It should be called "ex find the most ignorant parte body of law and file endless number of lawsuit per diem poop on your company"

When this lawsuit quietly became a non-patent suit in July the last shotglass of credibility Apple had was drank, by an alcoholic german judge that doesn't even know what an ipad or tampon is.

We are going to experience the fun new frontier of patent lawsuit warfare in the next few years. Seeing as how patent law has rules defined about as well as a grade school game of tag, this should be fun. One of my tenants is a corporate patent lawyer, she's having a ball.

Doesn't really matter if it's one picture or many, fudging with evidence is often a good way to lose a case.

I am all for competition (and everyone here should be as well, doesn't matter which company you love/hate), so I hope Samsung gets to launch their tablet in Europe.

Well, if it was an "evidence" as stated, then it would be a big deal. However, it's only a complaint. There's a difference.

A complaint can be true or false, and the information provided in it can be entirely inaccurate. It's the duty of the one filing the claim to prove that the claim is true and valid before a final sentence is carried out based on how the judge looks at the proofs. Most claims only need to include written texts.

An evidence, on the other hand, is what supports a proof, and it won't be of any use until there is a specific proof that requires it during the trial.

That's how I understand it, so Apple is in no danger of being illegal. You'd think their team of professional lawyers would have caught it if it was a photo taking over half a page.

I'd imagine that Samsung could sue if they felt that they had great loses, but really this is not a big deal. I very much doubt that apple did this on purpose, someone just done goofed!

Yes it was so blatantly doctored that they doctored the other photos too! Of course evil apple is doctoring all their photos to paint their case in a more positive light!

This was intentional on *someone*'s part. You don't "accidentally" Photoshop stuff like this.

Maybe not someone at Apple directly but you bet your ass someone in the law firm had a hand in it. As a lawyer, it's your job to present accurate data and evidence to the court. If you screw up, that can count heavily against you. Either the law firm Apple hired is negligent and incompetent or someone at the law firm, if not Apple itself, knew about it.

People make mistakes. Law offices employ people. Ergo, law offices will occasionally make mistakes.

There are probably a few misspellings in the document as well. I don't see anyone jumping on them for that. Not everything is an evil plot.

Most of the people I know that work as lawyers wouldn't know what photoshop is never mind how to use it.

They made the picture didn't they? They resized it and drew lines and everything. This is in a formal legal document. They knew what they were doing. I'd call that pretty blatant. I don't get what you are trying to latch onto here, but you really have nothing to hold your ground.

Yup. And it wasn't "simple resizing" -- it looks like the icons aren't stretched, but the borders around them are expanded instead.

Plain and simple, Apple or their lawyers doctored the photo because without it they didn't stand a chance.

I'm honestly not sure on European laws, but in the US whoever did it could be facing criminal charges for perjury. It may be a non factor in Europe, I would assume it is a much lesser offense there or they wouldn't have tried it.

my boss (the VP) doesnt know how to use photoshop, pagemaker, any of the programming or graphics and communications software i use, but it doesnt really stop him from asking me to do things... :hmm:
