Exactly. It was one of those ancient "morally correct" statutes to try and modify people's behavior - without anyway of enforcing the punishment.
In NY, adultery is a crime - a class B misdemeanor, but it hasn't been enforced in eons. OTOH, no legislator wants to be the one to introduce the proposal to abolish the statute (too hot a political potato).
