Well, the problem is that there is quite a difference between a cozy physciatriac ward and FMUTA state prison.

Also, once she is no longer "insane" she would be eligible for release. If she's lucky, she might even get weekend furloughs like the guy who shot President Reagan.

I for one feel this country needs to work harder on helping those with severe mental illnesses and take them more seriously.

I think her husband is guiltier than sin for leaving his mentally ill wife to care for their children and is as much a killer of those kids. And he is sane, so he has no excuse

Wrong again. Yes, she is mentally ill. But she still deserves to (in reverse order of preference):

1) Spend life in prison with no hope for parole.
2) Get fried in the electric chair.
3) Get forcibly held underwater slowly and painfully every day for a randomly increasing period of time, until one day she drowns. They should then wait until the last possible minute to revive her, and repeat.

It's the right verdict. She was clearly insane to do what she did.

It's not like she will ever be free again anyway.

Seriously, though, this is some hardcore BS. Granted, you pretty much HAVE to be insane to do that to your kids, but alternatively, she'll probably still get solitary... just in a padded white room instead of a hard concrete one.

Yes she is clinically unstable, but the fact of the matter is that the law applies to people who can recognize right from wrong (morally and legally). She could do this even when she was killing the kids. She knew it was wrong, but chose to do it anyways (more than likely out of depression). To make her get off scott free is kind of ridiculous IMO.

It sets a bad precedence for the law, which is most important. Of course she could have gone to minimum security prison and gotten counseling there, which would have secured the law and allowed her to get help, but by setting her to mental institute till they find her "stable" sets a terrible precedence for any other similar cases. Justice failed.

I'm of the opinion that even if you didn't know right betwen wrong, you should still pay the consquences.

Even an al Qaeda terrorist believes that what they are doing is right-- would that mean if we captured Osama bin Laden on US soil and some weanie judge determined he should receive a fair trial in the US, could he get off with an insanity defense?

You can be morally indignant and still know something is legally right or wrong and still be tried and prosecuted.

But Yates knew what she did was wrong, morally and legally. What I don't get is how the public can skew justice so far as to rape our justice system like this. She could have still been convicted and sentence to minimum security prison with rehabilitation treatment, and the law still would have remained intact. Now though, this case will be used for a number of cases to be overturned.

Shoot, I could probably go into a mental health ward and be diagnosed with slight OCD... It still doesn't give me the reason to start killing people and blame it on a Compulsion. The fact of the matter is she waived any responsiblity for what she did and is now free, even though she was fully aware of what she was doing and how it was wrong. It shows you how messed up our society is getting with no one taking personal responsibility for anything when it is something bad.
