Am I liable for this BS?

Events:

1. I sell person a laptop for $390 - $350 for the laptop, and $40 for a DVD burner I ordered.
2. I agree to fix laptop for three months (unless something was done to break it.)
3. Person pays $300. I'm in the hole $90 and have a DVD burner I can't use.
4. Person now wants a complete $300 refund if I can't fix the laptop within one day.

Can I legally (in the state of WI if it makes a difference) walk away from this?

1) why did you let them have it without paying it in full?
2) why did you order the dvd?


send back the DVD burner and refund the guys money. though odds are you can't do either. so take this as a hint that you shouldnt do anything like this again.
 
None of it is bullcrap as you apparently went into the deal without a gun to your head. Man up.

Also, I agreed to repair the laptop - not replace it. I can get a replacement motherboard for under $100 on eBay.

and how are you going to prove it? unelss she comes out and says yeah i did it then you arent'.

yes you agreed to fix the laptop. so fix it. next time don't offer one with anything.



edit; though if you want to. you can say the contract was never filled since she didn't pay the reminder of the amount. so you do not have to fix it.

Also, your verbal agreement was $390 for laptop plus 90 days warranty. The other party hasn't fulfilled their end of the bargain yet, so I don't see why you should.

EDIT >> Even without the DVD burner, they owed $350.

I fried 4 HP 6715's because they over heated the CPU so evidently HP would be one of those manufacturer's that don't include thermal protection. These laptops were sitting at a linux command prompt with no GUI loaded waiting to be imaged when they toasted themselves.

If I were you, though, I'd refund, take the laptop back, fix it and resell it with no warranty. Since you put a 3 month warranty on it, she likely treated it like crap with the justification that "he'll fix it".

Could've been configured not to sleep/hibernate with the lid closed, could've been a program preventing it from sleeping with the lid closed, any number of things.

This time frame seems like it is an unreasonable request.

Tell her you will do everything you can to fix it but it was working fine when you had it and have no reason to believe anything would happen to it.

Tell her to go to hell. She is still getting a good deal. Got a laptop for cheap, and in my eyes she never paid for your personal warranty.
She can take it somewhere else to be fixed.

There are many laptops whose acpi functions aren't supported under linux (especially so if it wasn't the pre-installed OS), so while I can understand it overheating under linux, I doubt it would under Windows or OSX unless those functions were manually disabled.

Even tho you didn't have a warranty in writing, you gave her your word. On the other hand she didn't pay you the $90....

So she needs to pay the $90 before you even look at it. Period.

Secondly, you need to stand by your word (even if you can legally wiggle out), as stupid as it was to give her 90 days. If you had a 90 day newegg warranty for a laptop, and you inconspicuously broke it before then, you'd return it too (most people would.)

So do the right thing and take responsibility for it like you said you would within 90 days, then learn from your mistake and never give someone 90 days again.

(And if the cpu is fried, its probably not all that expensive to buy a replacement, so you will atleast get part of your money back.)

That's obviously COMPLETE bullsh!t. Tell her you need the $90 first before you can even look at it, and then will need time to assess it and fix it if possible. Once she fulfills her part of the bargain, you can follow thru on yours.
 
I assume that your 90 day warranty did not include any kind of SLA that specified turnaround time on repairs, so tell her to chill while you see if it can be fixed. Assuming you can repair it, don't give it back to her until she pays the balance due on it.
