You went into the deal overly-favorable to the buyer. In any case I would want to medigate the one-day fix. Fixing the lap top within 24 hours is unreasonable, and the buyer should know this even if it's not written down on paper.

If you can't fix the laptop within a week or maybe two weeks, then you're at a loss. Now you know why a lot of retailers charge restocking fees ;) .

If you think the buyer is a carn artist or hostile, then obviously they did not deserve those terms in the first place. I would only offer those terms to a close friend or someone that earned a favoriable reputation.

If I were you, though, I'd refund, take the laptop back, fix it and resell it with no warranty. Since you put a 3 month warranty on it, she likely treated it like crap with the justification that "he'll fix it".

Could've been configured not to sleep/hibernate with the lid closed, could've been a program preventing it from sleeping with the lid closed, any number of things.

if that is the case the OP should have definitely mentioned that because if it died because of i'm sure 99% of all work like that

Simple contracts, like implied-in-fact contracts or expressed, are based on their substance and not their form. Sure, you can try to explain to the judge that you did not imply or express a "90 day warrentee", but do you really want to go that far?

Reading comprehension FTL. She only paid $300 of the $350 pricetag on the laptop. I am sure OP didn't say it was $300 for laptop, $50 for warranty, and $40 for DVD burner. Of course if he did, then that makes an even stronger case for him to not do anything, as in that instance she hasn't paid for the warranty.

Partial consideration favors the promisee even if the seller deemed it an incomplete sale. Return of lap top, refund of 300 dollars. Case close.

Why don't you find out what's wrong with it first?

Do you KNOW the cpu/mb is fried?

At this point, with the info you're giving, you're just assuming she fried it.

No. He's one of those annoying people who try to make a political issue out of everything. I'm guessing he listens to a lot of political talk radio. He uses phrases like "carbon con" and "eco-kooks," and he usually starts every post with two periods for some reason.

I recently ran into a similar situation. A buyer (co-worker) who had purchased a Dell 4100 from me well over a year ago complained that the laptop would not charge when the AC adapter was in. It ran on battery power until it died, at which point it would charge again when completely off.

After using it for 10 months with no issues whatsoever, she hit me with this situation and asked me to see if I could fix it. After I looked at it for a few hours and tested another battery, I gave up on it. She waited two weeks, then emailed me asking for a REFUND !!!!

Needless to say, I was pissed, but I am too good hearted to leave a PC user hanging (especially one that bought a PC from me), so I bought a battery and a AC charger for around $60 (she chipped in $20 upon my suggestion) and that luckily fixed the issue. I feel for ya, dude. Hope this works out in the long run.
