It was never changed. The ruling has always been "false" speech that incites violence, which makes perfect sense as I would want someone to yell "fire" if there was an actual fire approaching:

http://en.wikipedia.org/wiki/Shouting_fire_in_a_crowded_theater
The paraphrasing does not generally include the word "falsely", i.e., "falsely shouting fire in a crowded theater", which was the original wording used in Holmes's opinion and highlights that speech which is dangerous and false is not protected, as opposed to speech which is truthful but also dangerous.

Here's the exact quote from Schenck v. United States:

The most stringent protection of free speech would not protect a man in falsely shouting fire in a theatre and causing a panic.

Even if there was a credible threat, how would Sony get sued for a terrorist engaging in an illegal action? If I threaten to kill your dog if you leave it outside and I then kill your dog because you left it outside, I can't go on to sue you because you failed to prevent your dog's death from a credible threat. "If you'd only capitulated to the terrorists, none of this would have happened!" Because fuck freedom, we're scared.

Yep...the stupid goes deep in this situation, but it's not like we're encouraging them and others to try it again by giving in to their demands.

Oh wait:$

Ok you guys saying "nobody would care" if they made a movie about assassinating a sitting president are idiots.
Who are these people? Nobody has said that.
There is no precedent for this movie, never has a movie company made a movie about assassinating a sitting world leader without at least changing the name.
Not only untrue, but not even the first time the leader of NK has been killed. Kim Jong Il was already killed in Team America several years ago, and when he died his spirit came out of his body in the form of a cockroach.
If you can't understand the difference between a movie where the whole plot line centers around the assassination of a sitting world leader and a move where there is a single scene where amongst a scene with many other world leaders one gets killed, or between that and fucking puppets, then as I said before you are an idiot and I can do nothing for you.
Way to change the goalpost. Just admit you said something earlier that was untrue and take it like a man.
I'm all for patriotism but you are defending the Hollywood wing of a Japanese company that idiotically endangered its own employees and our citizens and caused a diplomatic clusterfuck. There is nothing patriotic about this and Sony deserves to be massively fined for this.
lol, not sure if serious. Now you want people fined for making art some find offensive? That is classic text book oppression, right out of history 101.
Freedom of speech does not cover yelling "fire" in a movie theater. Why? Because *it endangers people's safety*. That is EXACTLY what Sony has done here.
Nope, you're wrong--legally incorrect. Freedom of speech does not prohibit people from saying things others find offensive. I thought you said earlier on you were an American. You should read the 1st amendment.
Just to be clear, you think it's okay for North Korea to engage in cyber-terrorism and murder if something REALLY makes them mad? Gotcha.
I don't think he believes it's okay but he "understands".

Just an odd thought: (and perhaps it's coming from me because I probably find him incredibly over-rated)

Maybe this entire thing is a publicity stunt?

Hmm...just saw that they lost over 100TB of data...how could you not notice 100TB of data being pulled over your network😕

Private link.

Drudge has a link I haven't clicked about this movie having an orgy scene with Kim Jung un.

Btw, just to bridge over any silly idea that this is so much worse than team America, which came out a decade ago, paramount has pulled that from a theater that wanted to play it recently, too: http://deadline.com/2014/12/paramount-cancel-team-america-1201329597/

Npr covered some of Hollywood thoughts on this and they are not impressed. This has set a clear precedent now against "bold" comedies, though of course it can be against much more than that. Any movie that risks pissing somebody off will get a second look in case somebody throws a hissy fit.

See the Japanese want none of this, even though it's their own company. It's all well and good to talk big and claim you aren't afraid but if you were the one in Sony's shoes would you show the film? Not if you're smart, DPRK 100% has sleeper agents in this country and Jong Un is 100% crazy enough to have American citizens killed.

I'd also like to mention that although Obama said that he hasn't talked to the theaters, he also was claiming he "never talked to Sony" and told them what to do, which is bullshit. I guarantee you the owners of the big chain theaters and Sony were spoken to personally by the president or his proxy.

Yes never been done before. Find a single film where the plot line is focused on a sitting world leader being assassinated and they don't change his name. Puppets, cartoons, and shit you draw freehand do not count.

Shouldn't be tough, right? I mean assassination is one of the most popular plots in film and appears constantly in real life! Unless, maybe, there is a reason it was never done before?

I think the point has been made that the plot for The Interview.... probably wasn't a good idea to green light it...but it was done anyway.

but so what?

Dumb movies get made all the time. Just because some low level thinking dictator and all of his puppet followers get their panties in a wad over a MOVIE meant to make people laugh..so now the rest of the world should cower in fear?

hell.no.

edit: I think NK and all of the puppet followers/sympathizers should get over themselves. You are not that important. Live your crummy life all you want, you simply aren't that special to the rest of the world. As a matter of fact....movie companies want to make fun of you! 🙂

This goes all the way to the top! Obama personally visited EVERY SINGLE THEATER IN THE COUNTRY AND BOARDED THEM SHUT IN THE DEAD OF THE NIGHT TO AVOID SUSPICION! He even boarded up that place where we FAKED THE MOON LANDING and ORCHESTRATED 9/11 and INVENTED AIDS and REPLACED EVERY BIRD IN AMERICA WITH ROBOTS TO SPY ON PEOPLE. It HAS to be true; if it weren't, I'd just be a paranoid lunatic screaming nonsense at the sky!

Honest question: if your big concern here is not offending Kim Jong-un because he's crazy and he might kill Americans, how far do you go to mitigate the risk of offending him? What if he's offended by Dancing with the Stars? Do you take it off the air? What if he's offended by this website? Do you shut it down? How far do we go to capitulate a lunatic dictator because he's threatened violent reprisal against innocent people? What if he demands to be named "Emperor of Earth?" Do we go along with it? After all, wouldn't want to risk upsetting him, right? Where's the line?
