According to CBS New York, Alec Baldwin was arrested this morning for allegedly riding his bike the wrong way down Fifth Avenue.

When Baldwin was stopped, police said he did not have identification on him.

After allegedly becoming belligerent, police took Baldwin into custody.

The actor, 56, was spotted Tuesday morning being handcuffed by a New York City police officer for riding the wrong way on his bike.


"Alec was taken into custody in order to ID him and given two summons this morning in NYC," an NYPD spokesman told Yahoo, clarifying that the star was not arrested.



"One for riding his bicycle in the opposite direction of traffic and another for disorderly conduct. He was taken to the 13th Precinct and has been released."

A source tells Yahoo that Baldwin was indeed riding his bike alone on the wrong side of Fifth Avenue when he was stopped by police. Additionally, he did not have his ID on him, which is why he had to be handcuffed and taken into the local station.


"He became belligerent, yelling and screaming at the officers, 'I don't have ID. Just give me the f-----g summonses,'" a police source told the New York Daily News.

NY Police state. If Baldwin knew his rights, he'd realize the police had no right to ticket him or ask for ID. Such a violation is actually under the jurisdiction of the Environmental Control Board. Instead he's just a hot head, albeit a funny one.

I know many people that have been killed getting hit from behind by a car on bicycle, as recently as a few months ago lost a childhood friend this way.

I always ride going towards cars. I want to see what is coming at me and have a chance to get out of the way.

Not all laws are right.

But go ahead ride with you back to the cars.

Good. Most bicyclists have that same mentality, that they're "above" the people who pay for the roads and are allowed to do what they want.

Glad NY is doing what my state is doing, cracking down on these dangerous lawbreakers.

From what I read of the situation, he was stopped for riding the wrong way down a one-way street. He did not have ID on him when they wanted to write him a citation, so standard procedure is to detain him until they can verify his identity (as is allowable under NYS law). I'd hate to see the NYPD start issuing tickets and allowing people to provide fake names by not verifying their identity.

As the NYCLU says:

"IF YOU ARE STOPPED, QUESTIONED AND/OR FRISKED: Police may stop and briefly detain you only if there is reasonable suspicion that you committed, are committing or are about to commit a crime.
2. You should ask if you are under arrest or free to leave.
3. In New York, you are not required to carry ID, and you don’t have to show ID to a police officer. If you are issued a summons or arrested, however, and you refuse to produce ID or tell officers who you are,
the police may detain you until you can be positively identified.

5. Don’t bad-mouth a police officer or run away, even if you believe what is happening is unreasonable. That could lead to your arrest."

And I'm glad he was ticketed. I can't stand self-entitled asshats who can't figure out how to bike with traffic and a little courtesy. It makes my life more difficult when I bike due to people being wound up with their cycle-hate caused by their interactions with said asshats. (Note: none of this excuses bad behavior by pedestrians and cars)

In California a long time ago we had a similar case someone was biking the wrong way, was pulled over, failed to have ID, was arrested. During the arrest their bike was searched, and compartments opened up. Weed was found, and they were convicted of drug possession, and sentenced to multiple years.

The in a split decision the more left leaning justices upheld the arrest and conviction on the grounds that failure to produce ID was sufficient for arrest and full search.
 
In 2004 the U.S. supreme court upheld the constitutionality of laws allowing cops to detain you until you produce satisfactory ID.
 
Same guy that got kicked off an airplane because he didn't think FAA laws should apply to him and the FAs were singling him out. Life must so be hard for him.

BTW Dave, when I was 11 I was hit by a van when I was riding my bike the wrong way in the right of way next to the street. The accident was ruled my fault and one of the officers wanted to give me a ticket, luckily the other one talked him out of it. When you are riding with traffic cars can slow down and pass you when it is safe. When you are riding head on, they have no choice when they pass. Generally most traffic laws make sense.
