I was taught in my CHL class that the open carry was okay on your own property or property you have written permission to hunt. However, it all changes when you're carrying in public, open carry of handgun is illegal and depending on the officer they may choose to arrest/charge you for carrying a rifle or shotgun in public.

I see this as being more of a media event that is going to instigate some new pro-gun legislation in Texas as a result. It should never be left to the discretion of an officer if you're breaking the law, it should always require probable cause.
 
I wonder how many times he had to walk around with a rifle and get stopped by police before one slipped up and gave him a youtube video.

FYI. This guy is a loon. Totally unstable vet. His history is pretty sad.

The Texas legislator is already considering changes to gun laws to allow campus and open carry.

HB 1077 by Rep. Tim Kleinschmidt (R-Lexington) would prohibit institutions of higher education from enforcing policies preventing students from lawfully transporting and storing legally owned firearms in their locked private motor vehicles parked on campus.

HB 1078 also by Rep. Kleinschmidt eliminates the criminal penalty against Concealed Handgun Licensees carrying for personal protection on the premises of an institution of higher education.

HB 700 and HB 1194 by Rep. George Lavender (R-Texarkana) and Rep. Chris Paddie (R-Marshall), respectively, would allow a person with a Texas Concealed Handgun License to have the option of carrying concealed or openly holstered.
 
Theses circumstances always turn to a pissing contests. If you going to carry a gun in the US be prepared to answer some questions. Would have been better if dumb and dumber just shot each other.

That guy is active duty? Man, I weep for our country if that is what is standing between us and the military of other countries. More like FAT-ive duty.

And he's carrying an AR-15 with a 30 round clip just in case he encounters a coyote? I've seen coyotes when I'm out riding my bicycle, they are skittish creatures that will go nowhere near a person. I scared a big one on my street simply by yelling boo. This fat choad is full of shit. He went out there armed to the teeth with an agenda... to make this video.

First off the Army takes about anyone during war years, he'll be gone soon. Second coyotes don't always run off. And finally its not a fucking clip damnit, its a MAGAZINE for Christ's sake🙄

The was stopped by cops because they got a call from a scared citizen. This guy was being a complete jerk to the cops & had his son video tape all this. He sounds like a nutcase. If he cooperated with the cops instead of making them suspicious this all would've ended in mere seconds. The cops were very civil & calm in the video but he was acting all mental.
 
I think rule #1 for complaints like these is not to look like an idiot. It's like complaining about cops when you were acting like an asshole. Does that help your case? No. If you were doing everything humanely possible to keep the situation under control and to exercise your rights yet be respectful of the officer, then I'm pretty sure everyone will side with you. I really don't understand what's going on with people nowadays.

The guy who put up the video is acting stupid even if the laws concerning carrying weapons are on his side.

As an active duty member he should know that even if he's in the right you speak to people in authority with respect. "What difference does it make?" when asked why he's carrying a semi-auto rifle by a LEO doesn't meet that standard.

This guy probably received a lot of on the spot corrective training.

Answering "Well officer I'm carrying this rifle in case a wild animal gets to close." Probably would've been a better response. Raising his voice definitely wasn't a good response.

Like it or not even if he had a good reason to carry the weapon the LEO was in a position of authority and should've been answered with a direct to the point sentence instead of "What difference does it make?" which could be seen as disrespectful

If a cop stops me and asks my name, I'm going to say no (the WA supreme court has said that WA is NOT a stop and identify state.) This isn't about respect, it's about cops abusing power...

A cop stopping you and asking your name out of the blue is different than a cop stopping you and asking you why you're carrying a weapon after someone called about a person walking around with a rifle.

All he had to do was answer "protection from wild animals." instead he provoked the officer who whether he or you like it was in a position to ask with "What difference does it make?"

Sorry he was a) clueless or b) looking for a confrontation to film with that answer. He should have learned better being in the military.

He doesn't have to say a thing. The answer of "because I can" is as legit as protection from animals. Since when are our actions subject to the judgement of a cop? A cop isn't a judge, they don't interpret law. They are meant to enforce laws

Given the cop's response (grabbing a gun. If someone tried to grab my gun while I was carrying concealed, the person is liable to get shot) the cop deserves little respect - they certainly have no common sense or respect for the citizens.

Something similar happened to my brother this weekend: Family lives on a hill, backyard is a hillside really. Makes a perfect backstop for a pellet gun, you'd have to aim 45 degrees up to overshoot the hill. Neighbor called cops on my brother shooting a target in the back yard. Told police a kid was present, apparently (my brother has lived with my mother since my father passed away. There aren't any kids in the house hold.) Cops showed up, bro refused to open door. They left, came back with MORE cops. Brother finally opened the door. Asked if they had a warrant or were serving summons/similar. They weren't. Asked if shooting a pellet gun was legal. They replied it was. He closed the door on them. Cops are NOT on your side. They're on their own side, and it is in your best interest to say as little as possible to them.

Regardless of what you think, he could have started by giving the LEO a reasonable answer. "I'm carrying in case a wild animal approaches."
Instead he gave "What does it matter?" sorry but that could be seen as confrontational. He act no better than the officer.

If he answered in a more approachable manner and the officer still acted the way he did I'd be much less critical of him, but he acted like an ass as well. A more reasonable answer from the soldier might've had a better response from the officer.

It's hard to say for certain since they were talking over each other at times but at the beginning of the video the officer apparently says "Once I find out there's no issue then we're ( going to give it back to you) then you'll be on your way." The part in parenthesis is unclear because of the cross talking.

The way he carried on after the camera started recording indicates that he was looking for a confrontation. He gets no sympathy and it's obvious that you'd side with him even if he started beating the officer.

There's no use debating you about the video.
