Retired constable is wrong according to the law. LEO's interpretation of the law isn't necessarily correct. I posted a link to the relevant laws.

Sorry but I will take the word of a law officer as well as the other law officers and lawyer who shoot at the gun range where I shoot in Houston.

Like I said, it's not my problem if your local LEO don't know the laws, or want to interpret them their way, but you don't need to prove anything to me, just read it for yourself, it's right there in the penal code.
 
The soldier was a much of an ass as the LEO.

He had no excuse for the way he responded to the initial question. By the very fact that he went through basic training he should know how to interact with strangers in a reasonable and polite manner than most of the public.

Ok. 9 pages in, but I'm still going to say this.

Every single person here who thinks you need to answer a policeman's questions just because they walk up and stop you needs to get their head out of their ass.

You need to answer NOTHING, and unless they have a valid reason, non-answers are not a reason to arrest you.

For those who say 'just answer the questions'.... yeah. No.

Sure, everyone has the right to be an asshole to anyone else, and if you're so dead set on rebellion against authority like this guy seems to be then you''ll be treated the same way. Being polite and courteous seems to be lost on so damn many people any more...

The soldier still could've been polite while not answering the initial question. "I'm sorry officer, is there a problem? As I understand it Texas law regarding rifles allows me to carry this weapon openly in a non-threatening manner."

If he also refrained from raising his voice during the video then the ranking LEO who arrived on the scene would've seen a loud officer harassing a reasonable citizen who wasn't breaking the law.

As it was he saw two people behaving like asses, he's likely to side with the ass working in the police department.

Gee too bad military service members don't receive training on how to deal with other people and aren't instilled with discipline because if he was acting calm cool and collected more people would be siding with the soldier.... oh wait military members do receive such training.
 
the guy is pretty fat and out of shape for being active duty army.

I watched the video. The soldier said something about a back pain because of the way the officer positioned him at one point. If memory serves, the supervising officer told the first LEO on the scene to allow him to sit on the collision "bumper" because of this.

Back pain can severely restrict a person's ability to remain in shape, especially if they have slower metabolisms.

True, but if it were that disabling I'd expect him to be medically discharged (or administratively discharged for being overweight).

He might be undergoing that process. Because of the amount of money spent on training a soldier the military's procedure for discharging an overweight can take some time. He might want to stay in and be waiting for surgery that may allow him to be more physically active again.

I'm speculating of course. However, I'm sure the soldiers general attitude can affect whether or not his chain of command expedites a discharge for being overweight or if they give him more time to get his weight to within standards.

You won't get any argument from me about that. Being polite and respectful should be par for the course whether you're speaking to a policeman or a Mcdonalds cook.

But far too many people in this thread took the route of "just answer his questions".

You don't have to, and those people piss me off because they don't understand some of the basic rights we have in this country.
 
It's right there in the penal code, not my problem if they don't know it.

So basically, you can walk around your hometown with an AR-15, and everyone would just figure ol John is off to the dump to shoot rats.
Go over a couple more towns and walk around with your AR and your going to have 20 other AR's pointing back at you
 
I will report anyone walking around with a gun publicly.


i wouldnt call on that guy... i would observe, and make the rational decision that he's out with his son, shouldered weapon IN THE COUNTRY, in Texas..


i think it's mostly because i feel his pain, but i've been treated with that for possesion of marijuana before,
 
but i get it.. the cops were scared.. shit's wild in our country right now... something is horribly wrong..

we are divided. they've got us so scared of eachother.. thats what we need to see here.

i'm not afraid of the soldiers though, not ones like him. i hope it doesnt come to what i think it's going to...this is one of the first vids like this that really disturbed me.. the man is a rational man.


he handled it calmer than most people would, could you sit there and let them take your child? after what happened?


the innocent one, the child, see's something is wrong... when he wept, i got goosebumps, i couldn't be as calm as that man was.

It wouldn't matter here in IA. Still wishing someone would do this here. I admit I don't want the attention even though it would be completely legal for me to do so. Too many douche nozzles like the cop in the story.

Imagine if this guy was walking around with his rifle and ignored by police.
