Let's say you were in this situation. After chambering your shotgun, the intruder does not leave.

What is your next step? Say it again? Say it a third time? Fire away?

How much/little would it take for you to pull the trigger?
 
I would not have shot him through the door. I would've waited until he actually made his way inside the house or until I could see flesh.


No matter the situation, these never ever end well. Even if a burglar kicks your door down, aims a gun at you, and then you shoot him you better hope his gun was loaded and the jury isn't full of anti-gun nuts.

This country has made it increasingly more difficult to protect itself.

I would most likely fire a warning shot, but depending on the situation I would shoot first ask questions later.

You also better make sure that if you feel threatened enough to pull the trigger, you shoot to kill. WAY too many stories of lawsuits, etc.
 
A Remington 870 shotgun. No warning if he is in the house. The fucker will get it in the face, especially if I have a family to protect.

Realistically I would shoot center mass though.
 
I'm not going to fire through my door without him doing anything aggressive.
If he knocks down my door, sees me pointing a shotgun at him and still proceeds towards me, I would shoot.

What if he was a drunk neighbor and is at the wrong house?
Does anyone want to kill someone they cannot even see, through a door?
 
I am not allowed to fire until intruder crosses the threshold of my house - this include my garage. They must brake the threshold - from there I can fire away and will and most likely wouldn't say anything. Just fire once I verified my target.

I'm not allowed to fire unless I feel threatened (act of breaking in, still no in yet). Once threshold is crossed I don't even need that.

all that guy would have to do is continue inside my house. especially with verbal warnings. if he stepped foot inside knowing i was there, armed and willing to shoot him ill wait until i can see his face and his body is inside my domain and shoot his ass. i dont have much of a conscience so the act of pulling that trigger isnt that difficult of a task. ive already been tested on this part, so i know id do it if i needed to.
 
Here in Commiefornia, you have to attempt to flee the situation (run up stairs) in order to recieve a solid Justifiable Homicide ruling.

This is NOT how the castle law works. If it is this clear cut and he pointed an un-loaded gun at you, a jury will not be used. Castle law prevents any kind of trial-by-jury. It automatically justifies your act.

Bingo. We've had a couple cases here in KY. Intruder enters, armed or not. Intruder shot dead. Home owner didn't even go to a grand jury, no charges could because no crime was committed.

True that. I was wondering why wiki failed to include CA in the list of states with some form of a castle law.

I think we have a pretty decent amount of crime. Why isn't this statute in effect? Fuck, it should be lawful in all states.

Here in WI you can't use deadly force on an intruder, so I voted for fire, but not at them. If they had a gun and fired back I'd probably be screwed, but that's WI for you. Don't want to kill the guy and go to prison for murder or manslaughter.

Hmm, after a short google, I found another one that says "Wisconsin law only allows the use of deadly force when an individual is faced with deadly force" so I guess in that circumstance I would need to positively identify a deadly weapon before firing. Kind of hard to do that in a dark house though. If I racked the slide or otherwise indicated I had a weapon, and the intruder did indeed have a gun, I'd probably get shot first, before I could spot the weapon and react.

I'll have to look into this more. My parents are starting to keep loaded weapons near them, as they live in the country a ways from their neighbors and are getting a bit old, so this info would probably be useful to them.

We have a duty to retreat, but not in the home. California doesn't abide by the "castle doctrine" but there is no duty to retreat if you're in your own home. Please do research and don't rely on wiki for everything.

EDIT: Oh, and I won't rack the shotgun to scare off the intruder. I won't let him know in any way I have a firearm, just that I am calling the police. If he comes through the door and still steps inside when he notices me pointing the shotgun with 3" #1 buckshot at him, he is dead.

I don't aim for the feet, not try to hit him. If you shoot, you shoot to stop him from harming you. Stop = stop all life functions.
