Your Advice On A Bad Deal Received On Ebay

I bought a laptop on Ebay from a very established seller there. I tried finding one on here but nothing came through, so I went to Ebay.

Before bidding, I asked the seller several times whether there were any problems with the laptop, no matter how small. He said it was in good shape and looked and worked perefectly. He is part of a business in GA that resells laptops and other computer parts both in a retail location and on Ebay.

Well, the thing got here today and it was a mess. Mainly, the whole left rear area of the chassis is cracked off and missing, along with an on off switch for the wireless card that is built into the laptop that apparently used to be there. The other big problem is that the hinges on the screen are very very worn so that the screen wobbles back and forth when in the open position.

These are obvious problems that are easily seen, yet the seller claims that the laptop was checked out and certified by their technician and they were not there when it was shipped (yeah, right, you know?) None of the broken off parts of the chassis (about 3" worth off the left rear of it) were in teh box, so there is no way the thing was damaged in shipping. Another problem is that the left click button of the touchpad is worn out and it sticks. Remember, I specifically asked this seller on 3 separate occasions-before I bid, after I bid, and before I sent the payment, whether there were any problems with it at all, no matter how small and he said no, each and every time.

The seller says he "might" refund my main payment if, after receiving it, they decide that it was broken before they shipped it. He also refuses to cover the $24 it will cost to send it back to him.

I paid for it via a credit card Paypal payment.

So, what should I do? Risk sending it back and hoping to get most of my money back from this lying bastard? File a dispute of the payment with Paypal and or my credit card company and hold onto the notebook for now or go ahead and send it back and then file the disputes?

It does work ok, just is suffering from the problems listed above.

What do you think? What would you do, for real?

The amount was a little under $700 for a P4 1.8M laptop by VPR Matrix.

I'd dispute the charge with Paypal. If that falls through, get the credit card company to fight for you. That's what you're paying the outrageous APR's for, after all :)

Agreed. For once, a Paypal chargeback will work in your favour. Failing that, your CC company (assuming that you didn't fund with debit) will be similarily in your favour. Just be prepared for retaliatory negative feedback, and have a properly worded, polite, effective response, such as "Item was not in condition specified, seller would not accept return, chargeback was required."

Also, link to auction so that we may see the item in question, and pics of the damage if possible. This guy needs to make the Anandtech eBay Moron List. :)

Credit card company: ask them to place a "stop payment" on the payment you made to him and give them the exact reason you stated for why you're unhappy with the laptop: the laptop was not in the condition as the one you bid on. And prepare for "OMG HORRIBLE EBAYER SCAM ARTIST F------!" feedback just in case, but definitely contact the seller first and arrange a more fair arrangement, like you'll ship it back if he fully refunds your bid.

yep, good advice. Especailly the part about prepareing yourself for bad feedback. I had a seller ship an item to the wrong part of my city and he decided to leave bad feedback rather than admit he was wrong.

Ebay sellers are dicks and you have to treat them like that. Remember that the businesses on there are only on to make money. Be firm and remember that they don't care if your unhappy (hell, they sent you a laptop that is in 2 pieces) so you will have to do something about it rather than them.

I'm in a ebay mess right now. I paid some guy w/ 10 feedback $200 on the 28th of Sept for a Shuttle SFF. He has lied about shipping 2 times, said it shipped on the 6th of Oct. Now its the 16th, thats 10 days to go 1 state away. he has also stopped replying to my emails.

All I have done right now is put in a complaint to Paypal, and kept all correspondce. Unfortunatley I paid using a bank card, so I dont think I have any protection.

Did you put a complaint with E-bay? Was he selling other items on E-bay, maybe they are getting shafted right now.

PayPal/eBay have quite a few safeguards for situations like this, including filing a complaint with PayPal, PayPal Buyer Protection (Up to 500.00 for select sellers) and PayPal's Money Back Guarantee (Basically insurance again for select sellers).

Considering you funded this with a credit card I'm sure you'll be alright either way, although you may wind up being out the cost of shipping.

This is their policy for situations like yours:

All items sold by PS Electronics come guaranteed to be working unless described otherwise. We allow for a 5 days inspection period after the item has been received. If during the inspection period the item is found to be defective PS Electronics will, at their discretion, repair or replace the item.We only accept return or refund when item is DOA(death on arrived)Otherwise there are 15% restocking fee apply to all return item ALSO SHIPPING COST IS NOT REFUNDABLE.

So if you got in touch with them within five days, they have to repair or replace the item, which is left to their discretion. Again as you can see shipping cost is not refundable, however as per their policies:

When shipping items back to PS Electronics the customer will pay shipping costs. PS Electronics will pay shipping costs of warranty items back to the customer.

They should cover shipping back to you.

Let me also say that I would have waited before posting feedback if this is infact you, and that I wouldn't have even done business with someone who has feedback of 0-0-2....

Lastly as I mentioned before, because this is an established seller PayPal offers Buyer Protection up to 500.00 for free and would have offered their Money Back Guarantee for about 30.00....

I would dispute it first with your CC company and THEN Paypal. Paypal isn't worth sh*t when it comes to getting your money back. I know that first hand. What is the name of the company so I can avoid them?

Yep, that's them. Luckily, I learned a long time ago to use a different username on Ebay when buying vs selling, just to avoid the "retalitory" feedback these jerks threaten. That is exactly what happend here-the first thing the seller did was to threaten it, despite the fact that I paid him rightaway and did nothing wrong.


So, you guys really think it is better to dispute via credit card company FIRST and see if that works and to hold off complaining to Paypal?

Also, you think I should send it back and eat the shipping costs?
