Was unnecessary force used when two CHA security officers pulled their guns and fired on a drunk and unarmed man in 2013?


28-year-old Marlon Horton may have been stirring up trouble–urinating allegedly on an officer’s car early the morning of Sept 7, 2013. It’s what comes next that leaves Horton’s family undone.


Surveillance video shows Marlon Horton around 6:30 a.m. taunting or maybe being taunted–it’s not clear from the tape. Two armed CHA security guards watched, interacted, then reacted before drawing their weapons.



One of them–an off duty Chicago police officer—shot and killed Marlon Horton. Marlon’s alcohol level was twice the legal limit and the drug ecstasy was later found in his system.
 
Yeah, doesn't look like a good shooting and as usual the reporting stinks. They leave out that he was actively fighting with the security officers and then say he's being taunted, however, he advances on the officer that is pointing a gun at him.

He'd probably be alive of not for two things: not high on ecstasy and if the officers actually rendered some care like they are required to do.

I thought it was funny that at the end of the video, the brother brought up that they only paid attention to him because he was black. Uh, no. He pissed on the officer's car. That's what started the whole thing.

Well, there's two officers that we won't need to worry about being on the job anymore.

I just watched the video, and wished I hadn't. They shot him and just left him bleed. Neither of the cops did a thing to help him after he was shot.

I'm just linking to the 'declare you're over 18' page before the video. There are 2 videos. One shows the altercation and shooting and the 2nd shows him bleeding out on the sidewalk while the cops pretty much ignore him.

The aftermath is just stone cold especially in light of this:

"According to the transcripts, a dispatcher told the off-duty police officer, identified as Kenneth Walker, to “put a clean dry towel from where ever [Horton] was bleeding” . . . and to “keep him calm.”

But in the critical minutes after Horton was shot, he received no aid of any kind from the officers, according to the video of the scene."

I probably wouldn't be charging a guy with a gun.

The guy that got shot is approaching the guard in the white shirt that has the gun raised and is backing up the entire length of the store. If that's not the proper time to fire your gun, I'm not sure when is - waiting till the guy can physically reach you and the gun??

If the security guards had tasers, that dude wouldn't be dead; but people get butthurt about that as well.

Inconsistencies annoy me. "Black man this", "Black man that" is the current trend and it was absent. There's no protests. No riots. Nothing. As I watched the video I realized the most important factor wasn't that a man was shot. Not that he was left to bleed out and die. No, the shooter wasn't white. It could not be used by anyone to make hay and so a man's death becomes just another unfortunate event even if it was wrong.

The color of skin determines outrage.

For the record, technically they were armed security guards, although one was an off-duty cop. As I understand it, the female was not law enforcement.

I think it odd that as armed security guards they were not in any kind of uniform. Does anyone know what they were security for?
 
A guy high on drugs fights the security guards and then advances on them despite a gun being pointed at him. I don't see a problem with them shooting the crazy guy before he got close enough to take the weapon or cause other harm. Since the shooter was not an on-duty cop, I don't think there's any requirement to render aid after the shooting occurs either. One fewer crazy druggie on the streets I guess <shrug>
 
It was a justified shooting as far as I can tell. The dude kept going after the security guards after they backed away and kept backing away ....

#1 rule. Do not attack people with guns.

Granted they Could have rendered aid after the fact. It is immorral not to. That being said immorral doesn't equal illegal or criminal.

I also agree the thread title is bullshit.

Good for you and I don't mean that sarcastically, but I see more than that, or don't see to be precise. I don't see outrage and that is due to skin color. We're screwed up from this forum outward because people automatically assign weights without warrant to situations they don't know about for the very reason of skin color. If you want to say that "Yet another black unarmed man shot and killed by police" with all the outrage about skin color wouldn't the title if the shooters had been white then pull the other one. This won't have thousands of posts. This man will have died without much ado at all here because if the color of the police. Holder won't be standing over anyone here to see justice done. The community won't be protesting. It hasn't as far as I know. Remove any possibility of race and even possible murder is trivial. Perhaps you don't find that disconcerting, but I do. Every time a life is lost a clear determination of the events needs to occur and real consequences happen is warranted. You know who Michael Brown is. Without looking again at the article who remembers this dead man's name? Few. An insignificant difference? I don't think so, not in a larger context of how we value life.
 
Yes, the media and many people are racists. And many racists in media and this forum hide behind double standards and selective outrage to spew their BS. It's racist, it was it is. Race matters when needed to pursue racist agendas, when race won't serve an agenda it doesn't matter.

Though, thread title here, only issue I have is "unarmed". What the video shows is a rather aggressive and obviously dangerous man in a scuffle with two others.

One thing that sticks out in the video is at 1:22 when the guard initiates the kick to the dead man's feet area. Wondering what really led to that, that appeared to escalate inappropriately from my limited perspective.

After that I thought the shots were deserved. If a guy is charging at someone who has a gun there is reason to believe the person charging means to do great bodily harm (up to gets the gun and kills you). I'm not sure how people don't get this. The dead man was within a few feet (after charging towards) of the off duty officer when shots were fired

Most shocking part to me was not the shots (defensive), it was the young man charging at a guy clearly pointing a gun at him. How bout no, chill the fuck out and leave. But the dead man appears intent on continuing the scuffle. Shots were not a first resort here.

Obviously alcohol content and ecstasy means the man who died was not thinking as he normally wood and lost some inhibitions.

Also unarmed != non threat

This young "unarmed" man clearly throwing blows at the security guard and off duty officer at one point the off duty officer dropping to the sidewalk.

Calling 911 is the only medical assistance they were required to give unless they have specific training in treating certain injuries. Anything more than calling for paramedics opens you up to civil liability. Sucks but that's the world we live in
 
Strange incident, and it's always sad when a young person dies. That being said, what I see in that video is a drunk guy on drugs rushing toward someone who is openly pointing a gun at him. That is not smart behavior, and based on the video I would probably not find in favor of the family if I were on the jury. That being said, it's not clear to me that he even knew he was dealing with security guards, since they were not in uniform. This is a weird one all around.
 
Justifiable homicide. You don't constantly walk up to someone pointing at you. The gun is already drawn. If he got any closer, it would have been a struggle over a deadly weapon. Also, the altercation started because the dead guy took a piss on someone's car.
