your stuff was stolen when you weren't present, so the guy is a theif , but he isn't a "robber"

Well, feel good know its pretty much useless to any average person once you report it lost/stolen. Sprint will blacklist the ESN (number identifying the phone) and they will not activate it. I'm not sure how hard/easy it is to clone a CDMA phone (I imagine it can't be all that hard.).
