Soddy Daisy (population 12,800) is located 30 km north of Chattanooga, Tennessee)
The man in the blue shirt was riding a bike. He had been stopped by the Cop several minutes earlier. The Cop had been driving the unmarked, black police car on the left when he pulled over the man who was riding the bike.

A few minutes earlier the Citizen who recorded this had been driving his car past the point where he saw the Cop and another officer detaining the man in the blue shirt. The Citizen, who did not know--and still does not know--the man in the blue shirt, pulled into a parking lot (near a Wal-Mart, located camera rea-right), parked his car, and exited his vehicle. He then began to film the Cop

The Cop saw that he was being filmed, and he called for backup.

Shortly thereafter, a third cop arrived. This officer then approached the Cop who called for backup and asked: "Is that him?" referring to the Citizen who was filming.

The Cop then crossed the street, followed the the third officer. To establish a reasonable suspicion that would permit him to harass the Citizen who was filming, the Cop asked him: "How do you know this boy over here?" referring to the Man in the blue shirt.

The Citizen did not know the Man in the blue shirt, had never seen him before. But because the Cop can claim that he had a "reasonable suspicion" that the man filming him knew the Man in the blue shirt, he therefore could question and detain the Citizen, and in that devious way, stop him from filming. When the Citizen did not stop recording, the Cop knocked the Citizen's hand away and down, then yanked the phone out of the Citizen's hand, and handcuffed him.

The Cop places the phone in his pant pocket, then escorts the citizen across the street to where the Man in the blue shirt is standing.

The video ends when the Cop turns the recording device (cell phone) off. According to a legal expert, the Cop did not have the legal right to turn off the recording device.

So, in America, if you watch the police for any reason, they can detain you on any flimsy pretext they wish to conjure up.

a friendly reminder: don't get caught filming arrests or you will be arrested for filming arrests.

yeah i seen that. the cop was out of line and should be fired. hopefully the guy sues and wins big.

True, but this would be a non issue if cop A had simply ignored him. The best way to annoy "citizen" would be to give a kindly sarcastic wave and bow as he finished his business with bike dude.

More like a concerned citizen protecting his fellow citizen's Constitutional rights. Vigilance on our part, and harsh penalties for the offenders who break public trust are the first steps in taking care of these problems.

I hope the filmer enjoys his million dollars. Because that's what I'd be suing that police department, and those officers involved, for violation of my First Amendment Constitutional rights! :mad:

I could care less. My camera is rolling so your can have one too. I absolutely love my camera, makes life so much easier.

I used to drive through Soddy Daisy on my way to Chattanooga when I lived further north on the Cumberland Plateau. Can't say there is anything remarkable there at all.

My mom is from this area, just northwest of Soddy-Daisy (in the hills). We have a family cemetery up there about 10 miles or so away from town. Mowbray Pike-Mountain Road is an interesting stretch as it winds down the mountain.
