misdemeanor is still criminal offense.

I thought the the Windsor case is pretty old news. The attorney who was defending the 17 year old said you can still get charged for possession. This is just the district court and not the Ontario Superior court.

I did a paper on this case a while ago... but all my facts and court cases are mixed with the legalizing gay marriage paper I did. ACK!!!

I'm not sure what the law was based on exactly, the article was pretty vague. It just seems like a little high of a bar before it becomes illegal. 30g is plenty to hold a high-school dealer over for a day's work, unless it's a "high-traffic period"

30g as a day's worth? that's only about $300 CDN. That doesn't constitute dealing or trafficking.

I completely agree. What the feds here are trying to do is turn this from an Indictable offence to a summary conviction (felony to a misdemeanour for you yanks) much like a traffic ticket. They will have stiffer punishment for trafficking it though.

I'm quite familiar with whats involved with selling an OZ of pot. Only an IDIOT take an Oz to school and nickle/dime it gram by gram.
Unless the kid has signs up and a toll free hotline, it aint happening. He'd be caught it no time.
