I'm actually more irritated by people who keep repeating this and ignoring the reason why it happens.

If you're recording an unexpected incident, you just stabilize your phone and start recording. Horizontal orientation takes time for your phone to detect and delays you from starting the recording. It is significantly easier to fumble and drop the phone if you hold it sideways with one hand.

I tried to take a photo of an advertisement the other day and wasted 10+ minutes trying to get my phone to rotate before I had to give up trying (glitchy iOS 5 beta, + tethered jailbreak means I have to be near my PC when I reboot the phone). I've had this happen on other phones too. You just never know if you're going to miss something while trying to get your phone to detect the orientation.

This criticism is only valid when someone is recording a prepared statement or recording something that's not a spontaneous event.

Any grown man or male could have stopped that woman from being stomped. In the least, call the cops. No jury is going to convict McD's of any wrongdoing for stopping a brutal beating. Now they will have some explaining to do, especially regarding negligence on their property.
