Ok, since many of you here are in the workforce i figure i can get some advice. I've been working my current employer for 1 year since finishing college. I've been unhappy with some of the ways they've treated me but overall the expereince has been positive. Well the reason i am leaving is simply bc i have a much better opportunity that this current employer can't match. Well i start the new job in a month and a half but am planning on putting in my notice soon.

Here's my question....i am required by the company to give a 1 week notice to get my vacation paid out and such....would you give a 2 week notice anyways? I'm on great terms with them but would like to end my employment about two weeks from today....so do i give a 2 week notice which i was planning to do tomorrow? or do i wait a week and just give one week?.....what are the companies options when i give notice? can they just send me home, not pay me the two weeks? and BIG question....ARE they required to pay me two weeks of work if i am willing to work two more weeks after i give notice?....somehow i have the idea that they at least need to pay me for that time bc i am willing to work still. Thanks for any help.

Well, it is a matter of if they still are willing to keep you around or want you gone by week's end.

They're required to pay you for whatever hours you work, whether you've given notice or not.

But be ready to be escorted out 10 minutes after you give formal notice.

Depending on your industry you may be viewed as a liability the moment you declare your intentions.

Most companies will still pay you the 2 weeks pay as a lump sum.

reason i am really asking is financially i could use two more weeks pay from today to hold me over so i just dont want to get sent home right away with nothing more. There is a good chance they wouldnt send me home right away, but is there any reason they have to pay me that two weeks?

2 weeks is standard. An employer will think you're a complete douche if you do anything less. They're not going to fire you for quiting. They'll probably ask you to stay longer if you're on great terms.

I'd do two weeks and then go travel or take care of any business you might have between jobs.

Yes, because you're still working for them. You don't work for free for your final two weeks. I'm sure they'd rather pay you than deal with a lawsuit for not paying you.

Well i will be putting the employer in a tough position becasue i am currently covering for someone with a position above my current one while they are out on maternity leave....so i figure they will want me to stay around for a bit. Yeah i will def use the time between employment.

2 weeks is standard. Give them that. But make sure your car's trunk is empty enough for your desk trinkets and personal stuff when you do it, especially if you're in IT or any other sensitive department. If they have security escort you out, it's prettymuch standard to pay you for the full two weeks, even though you're DEFINITELY NOT welcome to come in and work for them.

If you don't do any sensitive work, or have responsibilities for things that only you know about, they'll almost definitely keep you around for those two weeks (and probably beg, borrow, and plead for more time to have you train your replacement)

btw it is most likely illegal for your employer to withhold unused vacation pay regardless of how much notice you give them.

really?.....yeah i thought so too but i just checked the employee handbook and it says vacation is forfeited if not 1 week notice given...i'm planning on giving two weeks and you guys answered exactly what i was looking for. Thanks
