CLIFFS:
1. Woman sold me cable box.
2. Cable company confirms box is not hers (they've never sold, only rented them) it's actually theirs.
3. Woman now ducks my phone calls. (Left her VM saying I want my money back by COB Monday). *note, i'm perfectly willing to give her the box back, though part of me feels compelled to give it to the company that legally owns it.

4. I'm filing suit in small claims court next Tuesday and contacting the PD in the town where I work (which is where the exchange took place.)


Problem, I know where she works (and have her work phone) but only have a cell number for her. Small Claims Court form says I need her home address. Does anyone have any suggestions on how to turn cell # into address?
 
How much is it worth? if its not to much money, you should just consider it a loss and not waste to much time..

Do it anyway. Ask for her address (knowing they won't give it to you) and explain why. She deserves it.
 
Found her address.

Filled out the paperwork. It's gonna cost me $75 to file it plus a $15 service fee. But, at the bottom of the form, it indicates that I can be reimbursed for costs (by the defendant.)
 
cable and dish boxes are notoriously sold incorrectly usually with PPV fees still owed.

You should ask for the esn/serial number and call your local provider prior to purchase.

BTW, where do you live where you think you can buy a cable company's box and think it's legit? Around here, they only rent them and you have to turn them in at the end of your service.

There's no need to insult me. I assumed that since you can rent one (for like 7.95 a month) it didn't seem too illogical that someone might sell one (much as they do with Cable Modems).

I bought in good faith what I thought she was in good faith selling. She was not acting in good faith. So, please, don't accuse me of anything illegal.

I now know that you cannot buy a cable box (at least for use with Time Warner) but I wouldn't say that's exactly common knowledge.

I'm guessing I'm in a similar boat. Canceled Comcast about two years ago and they never came and got the dual tuner hd pvr. Is there anything I can do with ?

You bought in good faith because of her good faith. She was selling something illegal for sale and you bought an illegal product. Small claims courts don't handle illegal sales. That's for the criminal courts. Suing this person for this will only confirm illegal activity and target you and her for this. Her acting in no good faith does nothing for your case. Example, try to sue for her providing you "fake" marijuana. Not going to work.

Naivete is no excuse. You've learned a lesson. Forget the lawsuit. Embarrass her at work and try to get your money back that way and then pay for your own cable the right way in the future.

Hahaha...they're not supposed to come and get it from you. You are supposed to take it back to your local Comcast branch office when you cancel your service.

Don't feel too bad, especially by the downers. I bought one too a while back, and then found out (here no less) that you're not supposed to buy them. Oh well. I still have it sitting around. One time I brought it over to my parents' to set up, and called the provider and told them I had this spare box I wanted them to use. The lady said "Oh, so you just brought over an extra one you had!" I could hear her winking on the other end of the phone. Anyway, I might see if this thing can tune RF antenna signals for my sister next time I'm at her new place.

Adelphia used to sell cable boxes, ended up being cheaper in the long run than renting. I can go buy a cable box for Shaw if I want, once again it'd be cheaper than the fees they want. I can pay $700 for the dual tuner HD PVR, or pay $25 or so a month for it, I figure I'll have it 3 or so years, save $200 in the long run.

small claims can order her to pay him the money back under a common law fraud tort claim. this is common knowledge.

Please stop dispensing legal advice when you have no idea what you're talking about. There is nothing inherently illegal about selling a cable or satellite box, it happens all the time. She fraudulantly sold him something that she did not own. He is entitled to his money back and will easily win in small claims court with the proper evidence (ie., craigslist ad.)
