Getting closer...
Seller's realtor (a bank... it's a foreclosure) is still trying to thwart our attempts to purchase the house...

First it was the estimate to repair the heating system ($9600)... I can have a brand new heating system put in for a fraction of that.

She thought that would stop us... It did stop our loan from going through, so we had to find a different lender. (one who wouldn't put the heating system in the contingency in the mortgage committment letter)

In the meantime, seller's realtor changes lock on house so that even our realtor can't get in.

New lender = need a new appraisal = need to get into the house.
Seller's realtor won't give our realtor the combination to let the appraisal agent in...
Appraiser calls seller's realtor - she won't return her phone calls to give her the combination (to a lock box with the house key in it)

So... our realtor says "we'll get it without her. (the seller's realtor)
Our mortgage broker, after being treated rudely by her said "we're going ahead without her"
Then the appraiser says she's going to go over her head to get the combination...

Everyone's doing everything without her now :)

She is the most pompous B---- on a power trip I have ever spoken to in my life.

Now, for the law experts... if we can show she intentionally or through neglect/incompetence slowed the process down, can we collect on damages? (by not renting our current house out while we live here, we're losing income.)

we were told that she has a backup offer..

If we get the house, the commission is split with our broker..
If we don't, she gets the full commission...
I don't recall what the commission was... I'm thinking it was 7k the last time we went through this.
But, it hasn't been verified that she actually does have another offer.

I think that was something she did to try to get us to back out...
I'm actually glad she didn't talk to the appraiser... I'm sure she'd have done everything in her power to get a lower appaisal. Not that it'd matter... we'd just have to give a larger down payment than we're expecting to. We should have about 15k left in our account for repairs, etc. after closing... I'm sure we can afford a good hunk of that if the appraisal comes in a little low.

sounds like shes cutting off her nose to spite her face.

realtors can suck. we got lucky and ours was great. always helpful and we never had to wait for any answers. good luck and hope you can get it.

I would talk to a lawyer...

so she lined up a buyer, and she is trying to get the full, rather than half (you have a buyer's agent) of the commision? what does your agent think? sounds like its a pretty short sited strategy on her part...

:D Once/if we get the house,
On the "Sold" sign they typically put in the front yard,
I'll put a larger sign around it that says "we do NOT recommend"

Getting closer... Appraisal agent went in today, and hadn't talked to the realtor. She was shocked that the purchase price was so low and said we'd have no problem with the mortgage to value ratio.

All we need to see is if the lender requires a new survey... if so, that'll delay us a few days or so.

Otherwise, all seems to be going good. Just gotta cross our fingers on the extension (Our lawyer mailed a request today)

According to the contract, there's supposed to be a penalty, but we're trying to get that waived.
However, if we still have to pay a penalty, then that realtor better hope damn well that the heating system is COMPLETELY shot, since it was the high estimate she offered us that resulted in the delay in the first place.
