Ok, so I ordered a case from this auction:

The guy comes back with this email:

OUT OF STOCK!

Our apologies but our supplier ran out of these cases and did not inform us
until yesterday. We are very perturbed about the situation and have
considered changing suppliers. Since you have ordered a case we can offer
you ONLY this case (6729029013), as we have been left without the rest. If
you choose not to receive this replacement we can refund you. Please let us
know what you would like to do.

Is this kinda shady? If I were to put something on ebay, and then I told the buyer I didn't have it, I'd get reported right? What should I do?

Many Power Sellers sell on consignment, and do not necessarily carry the inventory on hand. When they receive the order, they send the order to the warehouse of the supplier who then ships it out. All the money handling and customer service is done by the Power Seller. But in this case it does seem a little shady seeing that tomt4535 has a link that has the guy selling the same case...
