What would you expect to receive from this auction, based solely on that auction page without asking any questions.

I incorrectly assumed it was a brand new factory sealed ipod with all accessories. I received what looked to be a brand new ipod in a plastic sleeve shipped in a brown box, and nothing else.

Yes I know you should ask questions to know exactly what you're getting. I didn't, and realize it's my fault.

It does not say 'factory sealed' or 'includes all accessories'. I think the only thing you can assume is the ipod itself is new.



 
It probably "fell off the truck."

Call Apple, have their support people run the S/N, make sure it's legit and fully covered by them. If all checks out, in the end who really cares?
 
IMO, the listing is full of sh!t.

"This is a brand new ipod. Still in the box and wrapper. Please email with any questions."

He kinda fvcks you over with the last sentence, BUT, "brand new iPods" that are "still in the box and wrapper" include headphones, a CD, a manual, a USB cable, and so on. File a claim with eBay if it's really bothering you, you've got nothing to lose.
