I won an auction on 11/21/04, it says shipped within 1-3 days. I paid over $100 via bank paypal on the morning of 11/22/04. On 11/23/04 I emailed him and asked if he had a chance to send it I would need a tracking number, I did not hear back from him. So I emailed him again the evening of 11/24/04, no response. I waiting until the evening of 11/26/04 before emailing again this time I also called the number on the auction and asked that he return my call, no response.

At this point I am getting alittle worried. Since he has not responded to any of my emails nor even made an attempt to contact me. I filed a fraud report with paypal, today I get emailed by Paypal with the tracking number. He did not send it out until yesterday. And after all this STILL no contact at all with the seller

If I leave a negative do I have any action that I can take for retalitory feedback?

wait till the item arrives. if its in good condition....leave him a positive feedback but mention that he shipped real slow.

if item in bad condition...leave him negative feedback

You do realize there was a holiday last week ?

I'm sure 1-3 days means 1-3 business days, that could mean Friday or Monday would be within 3 business days since you paid him.

As sad as it is, many people on Ebay take a week to send out stuff.

i would cut him some slack for the holiday week... many people are out of town. It's bad planning to be doing that on T-giving week. Wait till the item arrives and see how it is. At worst, don't leave him feedback at all.

It is only three days... and a holiday weekend at that.

Ebay terms says the seller has 30 days to ship. Unless his auction terms stated that he would ship within a certain amount of time, there is really nothing you can do.

He probably just went away for the weekend.

:)

You could not wait , huh? I wouldn't file fraud until 10 days or something. Unless he said he would ship is with in a certain amount of days, you took a wrong course of action.

On the one hand, last week was a holiday week. On the other hand, the seller put something up with an ending date of right before a holiday week, knowing he had to deal with it. I think he sucks for not responding to your emails or phone calls and not shipping within the 1-3 days like he promised in the auction. I think you suck for filing a fraud report with paypal after only one week from the day you paid.

Give him a neutral for his unresponsiveness and slow shipping. Expect a retaliatory neg or neutral for filing the fraud report and/or for neutral feedback.

the fact that he still hasn't comunicated anything except giveing paypal the tracking number is realy weak but huge trouble getting the retalitory feedback removed is probably not worth it in this case as long as you get the item in good condition. if you leave a neg you WILL get a neg in return, it's ebay. ebay feedback is a joke at best.

Same question, different timetable:

(1) 11/17/04 auction ends and paypal payment sent (over $200)

(2) No contact or emails from seller at all, have sent him three emails inquiring and getting gradually harsher

(3) Seller has been on ebay since 11/02, 100% positive rating, fairly inactive (only 9 ratings).

(4) My last email sent yesterday gave him 24 hours before I start things like fraud report, negative feedback, etc.

It's sh*t like this that reminds me why I basically quit Ebay years ago.

I know it was a holiday week, if he had replied to one of my emails I would have been satisfied. But he hasn't sent 1 email stating what's going on.

Exactly. One must take into account that there was a HOLIDAY last week and many people have a life outside of eBay and the Intarweb.

to those who are saying "you should wait more" or "can't believe you bugged him over thxgiving" need to stfu.

waiting 3-4 days w/ no response is way too long. That's just bad practice.

Ok so even if it is thxgiving holiday, that is understandable, but if you know you are going to be out of town, don't fscking put up any auctions that will close on those days.

If someone doesn't want to deal with something during a holiday week, they shouldn't put something up for auction that'll force them to deal with it during a holiday week! Time the end date to correspond with a less hectic time! I'm not condoning the OP for filing fraud charges with Paypal, that was over the top and way too early, but I don't blame him for being pissed with the lack of communication and with taking 8 days to ship when the auction said it'd ship within 1 to 3 days.

What is this person's feedback rating right now? I have been making it a practice to only bid on those with a feedback of 40+ with 1 or maybe 2 negative ratings. If they are below that I won't bid on it and I'll wait until another similar item comes up from another seller.

If the item arrives as expected, I'd leave a neutral. The lack of communication bugs me too

as someone who has over 350 transactions (purchases and items for sale) recorded with ebay since 1999 (and my share of giving negative feedback), it's not abnormal to wait a week or two to receive an item.

i've learned -- and this is even with the most responsible of sellers -- that if you want an item SO badly that you have to email the guy almost daily regarding a follow-up, you might as well buy the through an actual online store rather than from an individual who generally does not have much experience with shipping and with being on top of every aspect of the sale (since there's no shipping department and other departments to handle transactions as opposed to the "big guys" who do this for a living). sure, it may be more expensive, but time is money, and emailing someone repeatedly to ask for an item is wasting time.

also, if you also want to keep your positive ebay rating intact, don't start up with some guy, because he'll give you negative feedback to retaliate (which also is relatively typical) and you'll look like a bad person in the eyes of a seller or a buyer in the future.

give it two weeks. keep in mind that the guy may have sent out the item and then decided to go on a vacation without computer access (and no access to his voicemail at home either). it may be on the way. UPS ground usually takes 7-9 days, so 10 business days is fair -- but even i would probably give it a few more days just to avoid receiving negative feedback myself.

also, if you're going to be shelling out a significant amount of money (that's for you to judge), you really should look at the person's feedback and determine if s/he is a reliable seller with higher-priced items. 100% positive feedback -- all from BUYING -- is often the way that successful con-artists get established on ebay. (that's not to say that this person is a con artist, but i also speak from experience on the fraud side of things)
