I just auctioned off some Radeon 9800 SEs that have XT and Pro features (L shaped memory, 256bit memory also, clock speed is set at Pro, can be softmodded, etc.) Anyways, I get this e-mail from one of them today:

Dear xxxxx,

When I bought this Sapphire ATI Radeon 9800 SE PRO XT 256bit 8x AGP Card from you, I bought it on the basis that it was an XT card from Radeon. It is not. I need a response at your earliest convience so that I may return this card and get a full return on my purchase. Please email me @ xxxxx@aol.com and give me your reply as promptly as possible. If you have any questions or think that I'm in error. Please feel free to call me @ xxxx. Thank you in advance.

Thank you,
xxxx

I put SE PRO XT in the title for the search function plus I clearly state twice it's only a SE card but with special features like I described above.

Is this guy entitled to a FULL refund? I think if I stated what the card was and he agreed to it, technically I don't have to.

Also, I already e-mailed him at his aol address and it bounced back. His phone number no one picks up, so I really don't know what to do.

Questions or comments would be appreciated. :)

Keep talking to him, but if you stated it's an SE clearly in the auction, you're in the right.

I don't know about this one. Can you post a link to the auction? If you do refund his money I would make certain you have the card first and it is still in working order.

That's the problem. He did pay for an XT price of a card (a lot more than I expected) so what I was gonna do is give him a partial refund since I can understand he could of been confused and I don't want to be a dick.

For right now, I really don't want to post an auction until the matter is resolved....later I shall.

Heh.

Ahh.. Well.. Hmm.

Tough. I do believe a partial refund is noble, though.

That seems like a fair compromise, although whether he bites is another story.

Based on your description, the buyer screwed up, but it's hard to judge for sure without seeing the actual auction.

Heres the text of the auction in question.
Hello fellow Ebayers!!

Today, you are bidding on a BRAND NEW retail-boxed Sapphire ATI Radeon 9800SE Atlantis video card. This card comes with a 256bit memory interface, as shown in the picture, not the 128bit interface that most of these cards have. This allows for substantially better performance and makes this a great card to have. I have tested this card for DOA, and it works BEAUTIFULLY. This card comes in its retail packaging box, along with an s-video cable, ATI driver cd, and a case badge.

I AM OPENING THE AUCTION TO EUROPEANS!!!!!!

If you are in Europe, and you are interested in the card, please send me an e-mail so I can tell you how much shipping is.

I you have any other questions, please do not hesitate to e-mail me. :)

HAPPY BIDDING AND HAVE A GREAT DAY!!!!!

Thank you for not posting the auction, I don't mind the text but I don't want his name on here as of right now.

I had a guy buy a Canon lens I sold on e-bay and he e-mails me after he received the lens and said that he bought the wrong lens and that he needed a Nikon lens. I told the guy that I was not running a retail store and that all sales were final and merchandise was sold as is. No refunds. I suggested he try to resell it on e-bay. He agreed and I never heard from him again.

I think we would need to see the auction link though. It sounds like you may have misrepresented a bit in your description.

It looked like you had 2 takers around the same price. Did the other guy say anything yet?

Hmmm, nowhere do I see the word XT in the text. I guess you're good to go. What's the main title of the auction?

The other guy's e-check hasn't cashed. This is BS, I'm not putting that in the title again. My roomate did this with another different video card and he got more bids. Stupid freaking ebayers. :(

It's in the title. That's the only place it's in.

The title was kinda tricky if you ask me, but It says nothing about it being an PRO XT or anything besides an SE in the text. So I'd say do what you think is best.

Yea, that's what I was thinking. Lesson learned. I'll talk to him and see if he'll take a partial refund back at least; I really don't want to go through the trouble of selling it again.

If it's in the title, and the only text for the auction was what you posted above, I think you should refund his money. His assumption - one that is fair - is that you simply forgot to put the XT in the text, after putting it in the title. This presumes that there is such a card as an SE XT. If there isn't (and it's one or the other), then he should have emailed you before hand to clarify, but given that you specifically put XT in the title I see no reason that you should not have _clearly_ stated in the auction text that it was not, in fact, an XT, but that you'd put it in there only for search or for the feature set.

Yep, you are right. I will be refunding his money when I talk to him.

Personally I wouldn't refund him squat. Why should you suffer because the idiot doesn't even bother to read the entire auction? Granted you had a misleading title but anyone who uses ebay knows that you should not just rely on the title of the auction. I'm sick of moronic ebayers.

Just ask your life partner how to become a better ebayer. Yes that was tricky of you but a better description like "XT like performance at an SE price!" would have helped.

In fact, your life partner should just run your auctions. :)
