YAET: (Ebay thread) What did I do wrong?

I won't bother with the long story, no one wants to read it anyway.

Cliffs:
1) Bought a LJ4550 color laser printer on ebay for $499, $0.01 shipping. It came with 8 toner cartridges.
2) Received package, printer was destroyed and toner was broken and leaking, also it was remanufactured toner, not mentioned in the auction (Not As Described according to Ebay rules). I took pictures of the package immediately, I even have pics with the packing label and printer in the same pic.
3) Filed claim for insurance with UPS. UPS picked up the package and returned it to sender.
4) Sender, after 1 month, claims UPS is telling him that the packaging was not adequate. UPS will not refund me, the money has to go to him - but he won't file the paperwork to get the refund, he already has my $500 and couldn't care less about what happens to me.
5) I just filed a claim with Paypal (I paid with Paypal credit, since paid off). During the filing process it informed me that the initial 30 day wait for him to respond would be skipped and escalated the issue automatically, making me think his paypal account is inactive or suspended (he is still active on ebay, selling 2-3 items per day).

What did I do wrong here? I get the funny feeling paypal won't take care of this. I can even take a lesson to be learned, but what's the lesson here? What did I miss? I've been ebaying for years and been scammed before, so I'm careful about things already.

It's tough. I don't know that I would send anything back to the sender without a refund first. Otherwise he holds the item plus the money. It sucks though. Ebay is turning into a scam fest. I guess 90% of my transactions have been legit though.

I had to return it to him, UPS wasn't going to process the claim without returning it. Not like he could use it, it wasn't repairable.

Well I just got off the phone with Paypal buyer credit and talked to a sympathetic english-speaking lady and she has filed a claim for the money, so things seem to be working ok at this point. I'm very open to suggestions on how to avoid this in the future.

How to avoid this in the future??? Really nothing short of not dealing with ebay/paypal, you won't be able to completely avoid it.

Next time I'd file directly with paypal first, then as a last resort deal with the shipping company.

when you go return something online like newegg or something, they don't refund you until they get their item back...so why would you expect any different on ebay?

As much as I hate scammers, when it comes to returns, unfortunately, buyers have to risk the most in that they have to return the item first before getting any money back.
