Just the facts:

- I won an item on eBay (4/9)
- Paid immediately with Paypal after auction ended on Friday (4/9) noon
- Item was marked sent on Monday (4/12) by seller but no tracking information was included
- A Paypal refund was issued for the full amount paid (4/13)
- Sender sent eBay message claiming the box and item was damaged in transit and the package was returned to send by the package delivery company (4/13)

Seller has 1 negative feedback back in 8/2008 for non-delivery of another item. Had only 3 recent transactions within the last 12 months of which 2 of the 3 occurred within the last 6 months.

My thoughts:
Fuck that shit! I won the auction fair and square. I am owed the item that I paid for. Refunding my money doesn't not mean the auction is voided and his obligation to deliver the item is nullified.

i would take this to mean that the seller is unable to replace the item, for whatever reason, with an undamaged item.

since you're being vague as to what was bought.... deal with it.

I had a guy claim that he dropped a camera once and he refunded the money... I kinda think he said that so he could re-list it again since I had won the auction $100 lower then normal price

Either way I was happy to have my money

No it doesn't. If I win something and I don't have enough money to pay for it, does that mean I'm off the hook since I'm unable to fulfill my obligation? No. What if I offer to pay to cover his fees for listing the auction? What if during the time that I won the auction and did not pay, the item could no longer be resold for what was the winning bid when its re-listed either because I overpaid and/or the demand for the product drops?

But to be honest, I thought I got a good price on the item. This may be a motivating factor why the seller may be refusing to sell me the item or a similar item.

I'd bet you'd be happier to have the camera that you won for the price that you won it for.

Assume for a minute the screen got cracked.

If the item is not under warranty from Palm anymore, the seller would have to pay to repair the screen, or buy you a new Palm pre.

What the seller is indicating is he's not going to do either.

Quit your bitching, and be glad he didn't send you a broke Palm Pre.

This might be over your head but I expect to receive a Palm Pre that is in the stated condition in the auction.

Whether the original item was really damaged or not is a non-issue.
