dealer should cater to your needs. you aren't happy, and you shouldn't be. you paid for a new car, and such is what you should get. pix of the crappy fix job?

There was a lot of overspray on the car, the paint matches but it has more metallic flakes in it then the original and some parts dont look shiny looks opaque. Its pretty obvious we are unhappy and if we payed for a new car we want a new car. Is there anyway that we can force the dealer to do rebuy the car or replace the car? Can we lemon law it since the value of the car has lessen? What legal options do we have? this is a new experience for us not sure what to do.

1. Sold car with bird poop damage on roof
2. Dealer makes attmept 1 didnt work
3. Dealer repaints roof, not clean as factory, unhappy with the job
4. Possible legal options to get what we paid for a new car? We live in CA if it makes any difference

Have the thickness of the paint tested, if you can conclusively prove that the dealer covered it up - you're in like flynn.

Why didn't you notice it on the car lot? (that is probably what the dealer is saying)

yeah I wish we noticed it at the lot but its along the middle of the roofline and we are kinda short and at eye level its hard to have seen it and the car was in the sun which made it less noticable. I noticed it when I got on the ladder in the garage to put something up top.

That should have easily buffed out, I've seen damage like that before plenty of times.

I would get a cheap depth gage and test it first before you do anything.

yeah the second time they took it they were supposed to call us and tell us what they were going to do, we thought that they were going to color wetsand it or at most repaint the spots and reblend it back but they repainted the whole roof.
Ill post pics tommorow as now the sun has gone down...

Hmmm... difficult situation. I can't see any laws that were broken by the dealer, other than them painting the car without your consent. Even then, you probably signed some papers when you took the car in that give the dealer authorization to make repairs.

I'm just not sure what to do, I guess i feel bad that my parents (dad specifically) doesn't enjoy the car cause of the whole situation, they were going to buy a camry or accord but I recommened them to buy a Infiniti. I guess we might just have to live with it and hope the value of the car doesnt drop dramatically because of it or the paint starts fading. If we have to go through the whole legal issues it would probably cost more then the depreciated value of the car. Heres a pic of the whole car pic

Must be a pretty recent change, because my '02 Focus' paint is only vulnerable to the underside of the floor mats (OOPS, *NEVER* put the floor mat on the roof and then slide it off) and the 80mph gravel chips that come with a PA license plate.

And I've definitely let birdshit to sit on my roof for weeks on end.

I suppose the best case scenario is if you resolve the issue with the dealer (perhaps by getting a new car?). If not, I wonder if Infiniti will step in try to work it out. What a fsck'd up situation.

Whatever you do, make sure that any contact you have with them from here on out is in writing. Make very certain that you get a complete write-up of the work done and have it signed by the manager in charge of the work. Also, make sure they put in writing why the re-paint was necessary (damaged paint)

The fact they even fixed the damage (I am assuming for free right?), when they probably didn't have to shows you right there that they are decent guys. I know many in the car business and they could have easily legally told his parents to go screw themselves as they didn't see the damage there when they bought it.

Second, it is a new car, it's going to depreciate a lot. Why do you care so much, it won't ruin the value as the roof was just repainted. If the overspray is really that noticable take it back to the dealership and have them give it a full detail, and claying and glaze will get rid of any noticable effects.

yeah i guess you have a point. The paint doesnt look all that good, it seems to be getting darker it doesnt really match the rest of the car too well and it has little pits in some places. Just we owned lesser value cars, didnt really expect this from a Infiniti car. If they told us the only option was a repaint of the WHOLE roof we would have declined it.
Edit: its not so much the value but the how long the paint will last. my parents don't buy cars very often the last car they bought was in 95!

Trust me, youre screwed dude. Ive been there done that too many times. Waste your time if you like, but Ill put up $50 that says you keep the car after all your efforts or trade it, sell it, etc.

Sorry to be so dower, but you dont have a legal leg to stand on. And what you might have isnt leaving small claims, which youll probably lose as well. Suck it up and move on. :(

yeah so true. The work order we signed only said "detail" but im sure theres some fine print on the back that say they can do what ever they want to fix it.

I'm going to write a letter to the dealer owner and Infiniti of North America. guess thats all i can do. Thanks for the replys I'll let you guys know how it turns out

Most dealers make you do a walk around when you are ready to leave their lot with your new/used car.

Happened to me.

If you miss something ---tough.

Consider yourself lucky if they work with you.
