Xbox 360 HD question

I have a secondary 360 with no HD. I have a few spare SATA drives, 80gb, I know I will be banned from Live but will I still be able to D/L stuff or does a ban ban D/L if I use the non MS sanctioned drive?
 
you cant even use any 3rd party hdd's w/360 at all, period.

well you can but it has to be a very specific brand and will only have a 20gb or 120gb partition, but like i said it has to be a very specific type of hdd and it requires a lot of work.
