Xbox 360 freezes on GTA IV

Never mind what I originally posted, it is the disk. I double checked the disk, and there is a distinct single ring carved around it. This is my second Xbox, my first one went on the fritz soon after purchasing it, and I think it carved this circle as I heard strange noises coming from it the last time I used it. The one I have now is from the product replacement plan at Best Buy. I hardly used this game disk, but now it appears to be ruined.
Is there anyway that I can get my game disk replaced as it was the faulty 360 which destroyed it?

Check with Take Two on the disc replacement. You should only have to pay a nominal fee.

How do I update it?

The disk is scratched, but mabye this could be the problem, how do I update it? Anyone?
 
If you're signed into Xbox Live and play the game, it'll ask you to update if you don't have the latest version. If it doesn't ask you to update, you have the latest version.

Ok, did that, it updated, and it still doesn't work. What should I assume is the problem? The disk?
