WTF.....

So I got into a car accident 2 years ago. I ran a red light and hit some old lady making a left turn. It was very minor, there was almost no visible damage to her car (her hubcap was scratched I believe).

Yesterday I get a letter from insurance: "You may recieve a summons notice within the next 30 days, please send this notice to us."

I found out that I am insured from crap like this up to 300k, the lady was not injured at the time of the accident, the ambulance even came and checked her, and as I said she had practically no damage on her car. How worried should I be? Should I gift all my savings bonds to someone?

What do you think?

ask a lawyer?

Thanks. I don't actually have the summons or anything yet, no details to talk to a lawyer about. Just wondering if people on here have had any similar exp.

If you had insurance at the time, the insurance company will have lawyers that will handle this for you. Call your agent.

Same thing just happened to a co-worker. Two years ago he was driving down a street and some woman parked at the curb pulled out without looking and ran into the side of his car. Ran into HIM! And now her passenger is suing my co-worker. Seems the woman who pulled out into the street without looking didn't have insurance, so the passenger is hoping to win some money from somewhere. The summons he got listed about a dozen reasons he was claimed to be at fault - driving too fast, being careless, not avoiding the woman driver, driving in an unsafe manner, etc., etc. What a crock.

The statute of limitations is two years and the passenger filed suit a month before the deadline.

At least you have a decent amount of insurance, they're not likely to just pay out if they sue for ~$300k, cheaper to use their in-house lawyers.
I wouldn't worry about it too much, just don't go talking to any attorneys that might call you.

If the ambulance people gave good documentation you should be fine. If the woman refused medical treatment, she shouldn't have a chance. If she did, there should be records and the hospital will have info.

Yeah, get a lawyer ASAP. At least for consultation- you never know.

read the thread, if he had insurance it goes through them. he can't hire an independent one.

It seems it's not uncommon to wait until just before the statute of limitations is up to file bullsh|t lawsuits. I think they're hoping you can't be found so they get a summary judgement against you - that almost happened to me about 10 years ago.

Don't expect your insurance company to fight it even if it's complete garbage - ambulance report and all. I had a police report saying I wasn't at fault. They will give them a few thousand to settle out of court - the insurance companies are at least as responsible as the lawyers for the abuse of civil lawsuits.

None of it will come out of your pocket - not directly at least. But at least in my case, it pissed me off just on principle.
