I sold a powerbook on ebay to an individual in Canada like 4-5 months ago.

he's just received a bill for Canadian Duty Fees @ 67.99 and he wants me to pay for it. I shipped it to him via USPS Express mail in which he received it in 2-3 days. Most of the times, it bypasses duty fees but looks like he got hit unfortunately.

He tells me that i'm am responsible for his duty fees and that it should have been included in shipping fee.

What a joke.

:p

**Edit**

Oh yea it was sold back in May so it's more like 6 months.

*edit*

to clarify, all of the canadians i have dealt with have been very knowledgeable in regards to the customs requirements. it looks like you happened to deal with someone that was unware of how it all works.

be sure to deal with reputable people and spell it out up front who is responsible for customs charges etc.

good luck!

(my apologies joinT ;) )

Make what clear on the auction ?
He pays tax for purchasing of goods outside Canada instead of within.

I dont want to be a dick to him since he's bought the item from me.
I've emailed him telling him what he's being charged is a Canadian Duty, not a shipping fee.
If he tells me that i should still pay, I'll just tell him no.

So basically if you included the customs duty in the shipping fee, and a duty was not charged, would he be asking for his money back now?

For big items, taxes may be charged. Probably not duty, since it's from the US. And brokerage fees are usually only about $5.

Here's something on calculating canadian duties.

No, I shipped it to him express from the US to Canada (2-3days) and they didn't charge him a duty fee when he received a package and for like 3-4 months went without a bill.
They just now sent a bill to him for the duty and he says that I should be the one responsible.
I dont understand how this makes sense.

Just tell him to fsck off. If you're in canada, and do business in US over ebay, you'd have to be an idiot not to expect the duty fees.

This is why I buy from ebay.CA

He shouldn't have "just" recieved a bill for that. Espeically if it was sent USPS. Duty is attached to the parcel as soon as it passes through customs. They won't deliever it to you unless you cough up the cash. I know, I've recieved enough stuff from the states that had been sent USPS. This includes everything from books to boxes of lab equipment. He's scamming you for some $$ for sure.

yea i dont understand how a bill can come up like 4 months down the road.
I mean I figure they would charge you the import tax/duty when they deliver the item.
Something is obviously not Kosher, but I'm not paying anything back to him.

Like I said, it's probably not duty.

Ffor USPS Express, it doesn't come in thru standard Canada Post. IIRC it comes in thru Purolator (Express Post?) and you can get charged brokerage fees and taxes weeks later (although not usually 3 months later).

If it crossed the border by Purolator, then the brokerage/taxes bill will be from PBB Global Logistics and they do usually send the bill a couple of months after the item has crossed the border.

Yes, PBB Global Logistics, except I almost always get the bill within a few weeks.

Fedex once took a couple months to send me a bill. $19.** on a $25 Suse Linux retail OS :(

BTW: Duties are the recepients responsibility, since they are issued by the country they are being imported into. Since he's importing the laptop, he has to pay Canada Customs duty on it.
