FWIW, I have worked extensively as both a prosecutor and a defense attorney, and I support prosecuting people in this situation for manslaughter, at a minimum, and potentially murder if the evidence is there. I don't know anything about this particular case, however.


Well how would you prove the intention to do it? I say it because it seems to me the next most likely scenario after mental illness. It would be hard to prove even if it were the case though unless they did something stupid like took out a million in insurance. His wife would support him no matter what?:roll: My wife would be lucky to survive the beating I put on her ass.
 
HTF do you forget that your daughter is in the back seat of a minivan?! Its not like they don;t have mouths. Maybe he was high?

Manslaughter doesn't require intent, just negligence. I would have no difficulty arguing that a father who forgot his daughter was in the car, and hence let her cook to death, was negligent.

As you imply, murder could only be successfully prosecuted if there were some evidence on which to infer intent (such as recent insurance purchases, evidence the parent was reminded to get the child, or something of that ilk), or, in the case of second-degree murder, that the parent acted with a depraved indifference for human life (which might be provable under the right set of facts).

I'm not excusing this (as I said, I think he should be prosecuted for manslaughter), but I have, for example, forgotten my bike was on the roof of my car, and driven into a garage (the bike, as it turned out, was stronger than my car!), and locked my keys in my car once or twice.

The fact is, people make mistakes - I think women are better parents than men when it comes to this kind of absent-mindedness, but anyone can have a lapse from time to time.

My guess is that the child seat was directly behind the driver's seat (so he couldn't see her in the rear-view), and she was quiet and perhaps sleeping when he parked. He just forgot.

My guess would be he got frustrated with having a baby whether the wife was in on it is anyones guess. She didn't work. Why the babysitter. You do not forget your kid.
 
This is a perfect arguement for mandatory Child Care Leave Pay, so one parent can stay at home with the child.
Still, this poor bastard has to live with it for the rest of his life.

I agree, i think having a program like that is bs. If you can't afford to have child and hve time to be a parent, you shuldn't be having kids in the first place.

Yes exactly what we need, Governemnt money paying for people to live how they think they are entitled!

This father should be prosicuted end of story. How do you forget your child is in the car? Sure we all make mistakes but to make that mistake with your child is in excusable. Get your priorities right folks and we just will not have theese problems.

I work about 50 hgours a week on a good week and I cjherish the few moments I get to spend with my kids.

It's ATOT, he doesn't need evidence, just an opinion.
The guy is definitely an idiot, but I don't see anything to support malevolence from what we know.
